She told police that three players pulled her into a bathroom, where she was beaten and sexually assaulted. On Monday, a grand jury indicted Duke lacrosse players Reade Seligmann and Collin Finnerty on charges of first-degree rape, sexual offense and kidnapping. Nifong said in a statement that the investigation continues and that he hopes to charge a third player in the case. Nifong's office said Friday he would not comment about Black's remarks. Defense attorneys have adamantly defended the innocence of the 46 players ordered by a judge to submit DNA samples. DNA testing found no matches to members of the team, according to defense lawyers. They have also said that photographs, receipts and other information will show that neither Seligmann nor Finnerty was at the party at the time the accuser says she was attacked. The release of information has been part of a very public discussion of the case, which has become a popular subject on television news shows. "I think the defense, just like the prosecution did early on, is trying the case in the national media," Black said. "I'm really sort of surprised a judge hasn't placed a gag order." Black has experience in handling high profile cases. Along with former district attorney Jim Hardin, now a state Superior Court judge, she prosecuted Durham novelist and one-time mayoral candidate Michael Peterson in a five-month murder case that was broadcast daily on Court TV. Peterson was found guilty in October 2003 of killing his wife and sentenced to life in prison without parole. Black left the Durham District Attorney's Office last April, saying that Nifong summoned her to his office the day after he was sworn in and gave her a letter of resignation to sign. She is now one of two Democrats, along with Keith Bishop, challenging Nifong in next month's primary. No Republicans are running. Bishop did not immediately return a call Friday seeking comment. "I don't believe it was proper or ethical for over 70 interviews to be granted to the media prior to the full investigation of the case," Black said. Such discussion threatens the integrity of the case and all of those involved, she said. She declined to comment on any of the facts of the case. "I believe too much information has already been disseminated," she said. "Some of the damage, I'm afraid, is irreparable. It's like trying to unring a bell. It's impossible.""

After the results of the first set of DNA tests all came back negative the DA discredited any DNA test by saying something akin to 80% of all sexual assaults don't leave traces of DNA. He then decided to do another round of DNA tests to be done in a special lab that is more accurate than the SBI lab.

It may be legit but that alone seems fishy to me. He didn't like the original lab's results so he does it over in lab of his choosing.

There's also the fact that a good number of rapes and even assaults are not reported until well after the incident (even days). THe victim has changed clothes a couple times and progbably showered more than a few times so the odds of DNA stick around that long are slim.
