Society is based on a social contract, but it’s extrEmely easy to reject this social contract if you have the resources to do so.
The GOP has basicallly rejected the social contract built up over the past few decades that people should at least try to find a common agreement on truths, and they’re now operating where only Trump’s truth matters.
It’s like a reverse enlightenment era philosophy.

I think maybe this was a win for the GOP in the sense you're describing, where a young, lifetime-appointed SCOTUS justice to win a solid majority on the Court is probably rightly viewed as worth a few Congressional seats in one election where they were likely to lose at least the House regardless.
...and maybe there some who made that sort of cold-blooded, realpolitik calculation.
...but I think a lot of the party was more on reptile-brain power on this one. They could have withdrawn him and replaced him with another jurist, interchangeable on policy and jurisprudence. They'd still get the SCOTUS power, they would have had an easier time confirming another nominee, and they wouldn't have further damaged their credibility and political capital and public approval. Yes, this might energize a few cretins next month, but no way it was worth the longer term and bigger picture damage over simply nominating someone else. I think a lot of the Kavenaugh thing was, from a Senate GOP perspective, just sticking their fingers in the eyes of Democrats due to some degree of justified rage at their tactics. "Owning the libs", as so much seems to be driven by at the moment.
That, and from the White House's perspective, a sympathetic vote in terms of executive authority, that might come in handy in the next year or more. Trump is the furthest thing from a wonk or expert on the finer points of jurisprudence, but he's a fucking top-tier expert at singularly-focused looking out for #1, and he loves a sycophant.10/11/2018 9:49:05 PM |

Yeah, that's basically what this was. Yes, Republicans are stupid like you said, but they are also ideologically committed to reducing the political purchase of their adversaries. Getting an absolute partisan like Kavanaugh on the court strengthens their vice-like grip on the levers of power. The Republicans long ago gave up trying to win the battle of ideas. So in order to maintain power, they have to dis-empower their political adversaries. They do that by denying their opponent (Obama) a court member, and by packing the court with their guys (4 out of 9 current justices have been appointed by presidents who lost the popular vote).
And that is how they undermine democracy in order to maintain power. And it's how they advance their ideological mission over a country that popularly opposes their worldview.
Assuming they'll pay some sort of price for their actions is politically naive at this point, because they are getting closer and closer to consolidating power to the point of not having to worry themselves with these silly democratic norms.10/12/2018 2:16:43 AM |

This idea that "honorable" men and women in government should rise above partisanship for the "good of the country" is a liberal myth that needs to die. Politics is about power. Always has been. ^^The state claimed it can only let “trained” people into the murder chamber where the actual lethal injection occurs for safety reasons. Being Alabama, the only trained religious leader they had on staff was Christian. The imam was able to meet with the prisoner before and was able to watch him die through a window, but was not allowed into the chamber where the staff Christian is allowed for other state killings.
It’s just so insane that after twisting itself in knots to achieve other “religious liberty” rulings like Hobby Lobby and all that other stupid shit, the majority ruled that this guy didn’t bring his suit quickly enough and they basically suggested this was all a delay tactic (more or less). They threw out this guy’s 1st amendment rights because it was inconveniencing the state’s lethal injection schedule.
Kagan’s dissent is like 4 pages (because the answer is so obvious), well worth everyone’s time.

Sounding like the census citizenship question is going to be found to be ok.
The 2016 election is going to change generations. Going to be a looooonnnngggg time to have a representative judiciary. In all honesty, as boomers die off something will have to change. We will have a radical right judiciary and a center-left population. It will be, at some point, untenable. There are members of Congress who have only been alive for one Republican popular vote win ever. Total minority rule can’t last forever.
