so hrm, say fuck it and get it continued one more time, then find a lawyer? why couldn't this shit have happened in pitt county

or couldn't i get it reduce to 9 over and if I fuck up again use my PJC or hire a lawyer then to get it dropped or improper equipment?

Friend of mine got a 21mph+ over in Johnston County on Hwy 70, and already had some kind of hit, so if this one goes through he may very well lose his license. He's an NC State student.

I already referred him to James Crouch and Lee...something, Jrb599 recommended him in this thread via nicklepickle. Are these guys only limited to Wake though? I have no idea about lawyers and all that stuff...

Lee is awesome. I've used him. Twice actually. He is a very nice man and considering he used to be a prosecutor, he knows how to get the job done. I would recommend him. He represents in Jo. Co. only afaik

fwiw, motorcycle cops have been posted on 40 all this week, and will continue to do so. typically between exits 287 and 285.

yeah, it was reduced to a non-moving violation, not sure which though (improper equipment, parking?). he specifically said no points on my license or insurance.

yea theres been one on wade ave right before the rbc centertaking radar morons jam on their brakes like he wouldnt know. he sits right after the bridge

I have never understood why people are so averse to braking when they see a cop. I know one guy who got an 80 in a 55 a while back. He told me he saw the cop so he let off the gas and applied a little pressure with the e-brake to slow the car down. So basically, you choose to speed past him, knowing you're going to get a ticket, instead of braking and hoping he hasn't clocked you yet?

I slam on the brakes if I'm in a position to get clocked. I can't tell you how many times I've locked up the wheels in full view of a cop. They may know I was speeding, but all I care about is what the readout on the radar says. If I can shave off even 5 MPH before getting clocked I'll gladly do it and let the lawyer sort out the rest.

yeah i wasn't trying to deal with the bullshit. took about 5 minutes standing in line and the DA immediately reduced it without asking anything but my name.

Oh well, I'll try to behave for 3 years. I imagine a passport or valentine will be my next frivolous purchase.

Why is this a problem? When I used to have a car where the cruise control didn't work, I would do this all the time--find a car going a speed I liked and just follow it. Made it so I didn't have to keep one eye on the speedometer all the damn time.

I got a ticket reduced to 9 over in December '05, then another, also reduced to 9 over, 1/07. My insurance did go up (3 points raises your rates, each of those incidents were 2 points) but it did not go up by 60%, probably more like 25%.

Six charged with fixing Johnston DWI cases

Smithfield, N.C. — A Johnston County grand jury on Monday indicted a former prosecutor, a former court clerk and four defense lawyers on charges that they fixed drunken-driving cases.

Former Assistant District Attorney Cyndi Jaeger, former assistant court clerk Portia Snead and defense attorneys Chadwick Lee, Jonathan Lee Hatch, Jack McLamb and Vann Sauls were indicted in the case.

Jaeger was charged with three counts of felony obstruction of justice, and she could face 81 misdemeanor counts of failing to perform her duty of office. A grand jury is expected to discuss those possible charges on May 4.

Snead was charged with six counts of altering official case records, felony obstruction of justice and illegally accessing a government computer.

Lee was charged with 65 counts of altering official case records, felony obstruction of justice and conspiracy; Hatch was charged with 30 counts of altering official case records and felony obstruction of justice; McLamb was charged with six counts of altering official case records and felony obstruction of justice; and Sauls was charged with 11 counts of altering official case records, felony obstruction of justice and conspiracy.

Johnston County District Attorney Susan Doyle last year asked the State Bureau of Investigation to look into the high rate of dismissed drunken-driving cases in the county. A WRAL investigation found that 46 percent of the driving while impaired charges filed in Johnston County in 2006 were dismissed, compared with 21 percent statewide and 20 percent in neighboring Wake County.

Doyle said a tracking system installed in October 2007 found several discrepancies in cases that were scheduled for trial but had been dismissed months earlier.

Sources said Jaeger gave a stack of signed dismissal forms to at least one defense attorney, and the forms continued to be used in cases after she left the Johnston County prosecutor's office in September 2007. She later worked as an assistant district attorney in Randolph County, but she left that position last Wednesday.

"Further inquiry revealed that the former assistant district attorney dismissed an alarming number of driving while impaired cases by utilizing an inappropriate dismissal form and by not stating the reasons for the dismissal orally in open court as required by law," Doyle said in a statement.

Jaeger's attorney, David Freedman, said she had "no criminal intent" in the case.

"She regrets the turn of events," Freedman said. "She has the utmost respect for the position of prosecutor."

The Attorney General's Office will handle the prosecution of the cases.

"The integrity of our criminal justice system depends on the integrity of the people who serve as officers of the court," Attorney General Roy Cooper said in a statement. "The grand jury has issued indictments based on the evidence presented by our investigators and prosecutors, and we will pursue these criminal corruption charges.”

Snead, who left the clerk of court's office last Wednesday, was given a $10,000 secured bond, while the others indicted were given $25,000 secured bonds.

"This is a sad situation for all involved," said Hart Miles, an attorney representing McLamb.

Miles said McLamb has "cooperated fully" with the SBI investigation and noted that McLamb wasn't involved with any DWI cases, only two speeding tickets and a driving with a revoked license case.

All of the defendants were expected to surrender to authorities on Tuesday.

Alright, so I got clocked at 70 in a 55 when traveling with traffic after exit 289 in that 55 speed trap zone. I got pulled once before 3 years ago and had a 68/55 reduced to 9 over (apparently I have a "don't give this guy warnings" sticker on my car).

I could get Crouch I suppose, but how much would that cost? How easy would it be to get this dropped?

I don't mind cars following me like this so as long as they are not close to me. If I feel a car is following me to closely, I'll take action to get them off me.

Alright, was doing 64 in a 40, I'm an idiot, wasn't paying attention to the speedometer. What should I do? Will my license get revoked? What kind of fines am I looking at? Recommendations for a good lawyer? I need help, this sucks.

Need a lawyer recommendation for Davidson county. Got pulled for 85 in a 70. Have a couple 9 overs on my record and the lawyer used a PFJ/PJC for the last one (I think they should have been able to get it reduced, oh well)

wow do you not realize it doesnt matter if they even get you on radar, a cop is trained to approximate your speed. when you jam the breaks you bring attention to your self and show them you know you're speeding. when you acknowledge you're speeding the cop will want to give you a ticket even more

I got on not too long ago for doing 35 in a 45. However as the cop was coming to pull me over, there was a person in the right lane (I was in the left lane) passing me. Yet I'm the one who gets pulled over for speeding? Why is this and can I use this to get out of my ticket? Also, I believe my speedometer is not truly accurate, is this a good defense?

not even gonna read, if you need one of the top lawyers in raleigh, pm me. i have 3 and they all kick ass and are pretty reasonably cheap

if one is out of town or sick im sure the other will be just as good. i trust them all the same and have referred tons of happy twwers to them

(not to mention ive never been to prison)

lol...Don't you work for a lawyer's office? If so then you should know that the cop's approximation is just about worthless in court without radar/VASCAR to back it up. Furthermore, if they're trained to approximate speed they'll be able to do it just fine whether I slam on the brakes or not. You ever seen someone get out of a ticket because they didn't "acknowledge" they were speeding? Didn't think so.

They know I'm speeding...I know I'm speeding...No need to play mind games. If I ever get a ticket for a speed higher than what's on the radar I'll eat my words. Until then, that number on the radar is about all I care about.

p.s., they were working Wade Ave. around the arena this morning. HP Motorcycle, HP Tahoe, and I think an HP Charger.

yes which is why i know its not worthless... but go ahead and get one where you were paced or whatever in wake co and tell the magistrate or d.a. its wortheless and should be dropped

I've had similar experiences where I was speeding by a cop, slammed on break and didn't get pulled over. One cop even pulled a u turn and followed me all the way onto the interstate, but no ticket.

Got a ticket going 20 over entering a school zone (literally 75 yards long) in Louisiana. I was driving a state vehicle and the guy just dicked me over on it. What to do? And will the ticket affect my insurance that is in NC?

Girlfriend on way back from mountains got a ticket for 75 mph in a 60. We had so many false alarms on my radar I think she ignored the warning,
beyond a light brake tap, even when the Ka band went off.

Is it worth travelling back to Lumberton (1 hour drive) from Wilmington to get this ticket reduced to 9-over??

I may be wrong, but I've been told if it's not reduced to 9 over NC will suspend your license (because 15+ is reckless driving).

They can, but usually don't. It depends on your driving record.

just got a ticket for an 80 in a 65 on I-40 by exit 284. planning on showing up and trying to get it reduced to 9 over.

i had a stop sign infraction 8 years ago and used a pjc on that, but other than that haven't had anything else in 10+ years.

i've read conflicting things about 9 over tickets. can they affect your insurance if you get multiple tickets in a certain time frame(if so - what is said time frame)? is it dependent on who your insurer is?

this is what we say in our letters :
"North Carolina General Statute 58-36-75 prohibits your insurance company from assessing you any points or surcharges if you are convicted of speeding 10mph or less over the posted speed limit, and you have not been convicted of any moving violations within the three year period prior to renewal of your insurance policy."

I just received a well-deserved ticket in Winston-Salem. I was going about 85 in a 65 on B-40, but I was very polite with the officer and ended up with a ticket for 74 in a 65, and a citation for failing to notify the DMV of a change of address.

1. I have (had) a clean record, so I'm assuming I should just mail in the $145 for the 9 over?

2. The officer said that I could bring my updated license to the court date and get the DL thing waived. Is there an easier way to do this? Taking a day off to show someone my license seems like a waste. Can I call the DA or something?
