I looked around and couldn't really find the answer I'm looking for.

I've never been in court before so I'm lost with this issue.

My husband accidently broke his cousins window the other night, and his cousins wife pressed charges on him. Before we left the house that night, she hit my husband, so he pressed charges on her. Today I replaced the window, and they decided to drop the charges, but we didn't know the magistrate and DA wouldn't drop the charges. We were told just to go to court and to ask to drop the charges.

Will this lead to a serious fine, and what about court costs? I don't even know how much court costs are. Will my husband and his cousins' wife split the cost, or will they both pay the typical fee?

I really don't have a clue about this, and its a messed up situation, so bare with me.

court costs are $110

but its hard to drop charges once youve pressed them, especially assault charges. the property damage charges will be a lot easier to get rid of if the "victim" goes in there and says that it was an accident and the window has been replaced. bring a receipt and crap. but the assault really cant be fixed, so good luck getting that thrown out. court system doesnt like it when people play games.

the problem is, she took out 5 different warrants on him, 4 of them lies, and he has a record and hes on probation- we kinda need them dropped so he wont be looking at prison

the probation officer called him about the warrants - his cousin called the probation officer (what a family ya know)

lesse... there was one for trespassing which is funny because we were eating dinner at the time this happened, one for communicating threats which i dont know where that came from, one for assault, she said he kicked her, one for harassing phone calls yet they dont own a phone, and the one for the broken window

The only one thats true is the broken window, and I fixed it today


His cousin isnt doing anything - its his wife - she has something against my husband and I have a feeling shes trying to pull shit to put him in prison

if thats true and it can be proven, you can pretty much have her charged with obstruction of justice. and once its proven that she is a liar, the DA will be a lot more likely to drop the rest of charges

how much prison time does he have suspended right now btw?

The DA can continue an assault charge, even if the plantiff drops the charges...weird how that works

32 mths :-(

an accident happened when he was in jail over a fight - dont laugh because its horrible - but hes on SERIOUS medications for some mental problems and the jail refused to give him his medicine so he went crazy for a week and set a padded room on fire - so now he has a 'burning a public building' charge (dropped from arson)

yeah tell me about it - but they gave him a lighter for him to smoke so its their fault

and they should have given him his medicine, he cant help it that his chemicals are all outta whack

I just recently got off assault charges. I went to court 3 times and the guy that pressed charges never showed up so the judge dropped it. Didnt have to pay any court costs either. I was told though, if you can get a note saying they dont want to press charges and have a witness at the signing and get it notarized then you can get it dropped first time.

I'm going to give you the best advice you'll probably ever get. I know he's your husband and that you probably love him, but you need to find some less fucked up, more law abiding people to have in your life. Just seperate yourself with the lot of them if you know what's good for you. Otherwise, you'll either be dragged into their mess or you'll be overly stressed from pulling those you care for out of it.

if your guy's about to get some prison time over this bs, then hire a lawyer. Don't let some crazy bitch ruin you and don't think you can go in and get this settled on your own. You might well be able to but if you get a judge in a bad mood or the DA or the cops are mad that someone's playing with the system, you could be in trouble. The $$ it costs to get a lawyer is minimal compared to doing 32 months and you can always take your cousin to civil court over this if the legal fees pile up.

Your husband and family will probably end up in people's court if no law enforcement was involved. Just do mediation. Also, North Carolina is a no drop state . Charges can be dismissed, but they can be reinstated if they are voluntarily dismissed. If its dismissed by the court they can't be reinstated. With actually working at the DA's office, you get to repeat this whole thing so many times.

Umm, yes! If you gave an inmate, who hasn't had his medicine, a gun, you are responsible with what he does with it.

Sounds like an accident to me, window breaking, people hitting each other, than pressing charges. Doesn't look like anyone has anger management issues here. I think many preteens are more mature and rational than these people.

it was an accident - we were sitting in the living room and his cousins wife asked my husband to throw her the remote, she didnt catch it and it went through the window - she got pissed and hit him, he NEVER touched her - we just left because shes a crazy bitch and didnt know what else she would do

I didnt want him to press charges on her, but the probation officer said it would look best with the case because she was at fault also, and is lying out of her ass (we have pics of the bruises from where he hit her)

Yesterday her landlord called and said he was pressing charges if we didnt have the window fixed that day, so I went uptown and paid $17 for a piece of glass, and my grandfather put it in for us (she reported in the warrant the glass was worth in excess of $400)

When we were leaving, she asked 'Dont you wanna drop these charges" and the best thing we could think was, yeah for my husbands sake go ahead, because this shit is stupid - the DA said we shouldnt have a problem in court with it, but god knows how thats gonna be

I cant help what his family does, they are screwed in the head, and therefore he is no longer allowed around them because Im sick of their shit - but he doesnt deserve this because of an accident, and he may have made mistakes in the past but hes learned from them

Its bad when you watch your husband cry for 5 hours because hes afraid of whats gonna happen, when its not his fault, and theres not much we can do

I think the above is a typo, pics of where she hit him as in the above story.

And honestly at this point, i'd get a lawyer. The bitch isn't going to stop, i've known these kind of people before and they DO not stop, so it's far better to continue with your charges and prove her to be a liar and harassing you. (at least from a getting rid of her perspective, dont know about legal)


but seriously, get a lawyer. People like your cousin's wife are sweet as long as they're the one in shit and hope they can get out of it.

the phonecall to the probation officer was placed at another cousins house, which is why i mentioned earlier that i didnt want him around the family

i have no reason to lie about anything on here, the remote cracked the window, it didnt shatter or fall apart, its just i figured it was considered broke because it was his fault, and yes i was willing to replace it

i can understand im getting a lot of criticism because it may seem like i dont have the best husband or im not in the best situation - which is fine - but i enjoy my life and im happy with my husband, hes changed since his past and we were trying to keep it that way, until his family started their shit

we're getting a lawyer, because thats all thats left to do, and we need the best outcome, of course
