i think that they should make a warning DUI for people 21+

cop pulls you over... and if he/she smells alcohol and you blow ANYTHING at all, you have to get one of those machines. even a .02 -- i mean .04 is half drunk, right?

it's like the commercial says... buzzed driving IS drunk driving. most people don't consider themselves DRUNK until they're at like .15, and that's a fact

i think that anyone who shows that they will drink even one drink and get behind the wheel is a liability and should be forced to install one of those. hell, any responsible person would WANT something like that, just to make sure they don't ever drive drunk on "Accident" after having some wine with dinner.

(i know you all know someone who has had a DWI after only 2 liquor drinks)

ps - anyone who says that addiction isn't a disease is fucking delusional

Moody faces charges of DWI, felony death by motor vehicle, felony hit-and-run and misdemeanor child neglect.

Several lanes of Capital were temporarily closed while police worked the scene of the wreck.

Moody was being held in the Wake County Jail under a $102,000 bond late Saturday afternoon. His first court appearance was set for Monday.

My biological father is such a piece of shit that he will drive around with that fucking thing beeping rather than put on the seatbelt. He drove from Georgia to Durham with that thing beeping the whole way apparently. I wouldn't ride in the car with him because I refuse to be killed by his projectile carcass when he gets in a wreck.

Luckily I only see him once every few years at most (Hopefully never again now), so it's not really a problem.

y'know i agree with this 100% until your "consequences" and "fuckups" involve the deaths of innocent people.




call me a fascist, but i'm not willing to sacrifice my life, nor my family and friend's life, for your "ability to do what you want."

I'd just as soon see you gutted with a serrated blade and hung as an example as one whose yearn for freedom was such that he'd die for it... but executed because he was reckless enough to kill for it.

It seems like most people who ever consider driving drunk are far more concerned about the police than they are actually hurting anybody, because of course they think they can drive just fine. But no matter how well you can drive, you can still run into a checkpoint or otherwise run into a cop. It's hard to increase the police's ability to catch drunk drivers, but it's damn sure possible to increase the consequences when they do.

Reduce the legal limit to, say, .06. For the first offense, take away their driver's license for ten years. For a second offense or driving without a license, no less than two years in prison and license revoked for life. A truly zero-tolerance policy like this makes the consequences more expansive and severe in a way that I think would play very strongly in the mind of a potential drunk or buzzed driver and dramatically reduce the incidence of either.

To be honest i do think the limited privileges thing is too slack but other than that the laws are fine the way they are. As with anything some people get arrested who probably shouldn't have and others don't get arrested who probably should have been. The people that are barely over the limit and get popped really are no danger to anyone unless they are inexperienced drinkers and their bodies have 0 tolerance. The people that you usually find out that killed some one are the people that would blow a .19 on a Wednesday morning (over exaggerating). But there has been studies that show people that are slightly sleep deprived are much worse drivers than those who are slightly over the legal limit. Now those who have been out till 3am and have been drinking have the combination of sleep deprivation and alcohol that is a compound problem which also makes them horrible drivers.

All I'm saying is you're giving people with no malicious intent charges that imply malicious intent.

I also have an issue with the consistency of how alcohol is viewed by the government. A person can claim rape because they were too intoxicated to know better. But a drunk driver is always responsible for their actions.... I don't care which way it goes but please keep it consistent either you are or are not responsible for the poor choices you made while under the influence.

I think useful, intelligent people are able to see a consequence this severe and factor it meaningfully into their decision-making process. The point here isn't to punish, it's to deter, and I think drunk driving is one of those things where deterrent has a good chance of having a serious effect. Extreme penalties are likely expensive, but I think the aggregate effect here would be positive both economically and socially.

How is it gross negligence? From a probability perspective relative to how many people drive drunk there are not that many accidents, and even less fatal ones. I'd say gross negligence should be something mathematically significant, like using fuel known to be contaminated in aircraft where the odds approach 1 in 100 instead of 1 in 10000.

He was driven home by friends and slept for a few hours before waking and driving to class, said Rusty DeMent, his defense attorney. A police officer took a Breathalyzer reading after the accident of 0.12, said Wake assistant district attorney Jeff Cruden. It is illegal to drive with a level of 0.08 or above.

'You have become a teetotaler'

In exchange for Reid's guilty plea, Stephens structured a punishment of his own. He waived a two- to three-year prison sentence and put Reid, who has no criminal record, on probation for three years. During that time, Reid was ordered not to drive or drink alcohol. And, he must perform 400 hours of community service, including 100 visits to local high schools to talk about the dangers of drunken driving.

"If you consume alcohol, the sentence will be activated," Stephens said. "You have become a teetotaler."

Reid will also have to spend five weekends in either the Wake or Alamance county jail and pay more than $10,000 in restitution for medical and funeral costs. His hometown is in Alamance County.

Stephens told him the punishment was not harsher, in part, because of Ross Leidy's request for leniency.

Reid was asked by Stephens how he ended up in a criminal courtroom, despite growing up with a close family, good schooling and opportunities.

"It comes down to myself making a bad judgment call," Reid said before receiving his sentence. Hoping to avoid jail time, he added, "Why should I be just another statistic?"

Stephens responded, "The question is, why shouldn't you be just another statistic?"

His lawyer submitted a notebook filled with 50 to 60 letters from family, friends, church members and fellow fraternity brothers of Phi Kappa Tau. Reid is now taking classes at Alamance Community College. He had hoped to become a Navy pilot, but that may be impossible with the felony conviction, DeMent said.

Leidy, who taught in NCSU's toxicology department, took time Thursday to describe his wife. The couple met in 1970 at Auburn University, where he received his doctorate and she was a recent graduate. They married in 1971 and moved to Raleigh so he could teach at NCSU, a professorship he held for 31 years until his retirement.

He said she was caring and compassionate, the type of woman that threw herself wholeheartedly into projects. When Nancy Leidy decided in 1996 that she wanted to enter jams, jellies and baked goods in State Fair contests, she ended up winning more than 100 ribbons in the next six years, including two Best in Shows, her husband said.

In 2001, when Nancy Leidy found that she was of Irish heritage, she began learning Irish Gaelic, eventually becoming fluent. She also enrolled at a university in Ireland, where she spent summers studying the language.

She became so close to Ross Leidy's students over the years that that many flew in from all over the country to attend her funeral, her husband said.

"A lot of my graduate students considered her their surrogate mother," Ross Leidy said.

Since his wife's death, Ross Leidy has found himself the sole caretaker of her parents, ages 98 and 95. He spent the past few months since her death moving them into retirement homes in Alabama.

"Nancy and I were a team, we were lovers, we were companions," Leidy said. "

I think they should change it to something like .12 and if you blow it, you lose your license for 10-15 years without any classes or anything.

I'm pretty sure that I'm more aware and safe with .10 than a 16yo girl with a cell phone - and there fewer people on the streets.

It's obvious the person lacks self-control and/or reason, this will make them remember that the government controls the roads and it is his or her privilege to drive on them.

Of course this would never work, because it would instill the mindset that a person could drink more than they could have previously and still drive.

OTS runs the city's bus system.

Morton said the company was aware of Pestana's 2002 DUI conviction, but allowed him to drive again after he successfully completed rehab.

"Both in terms of customer contact and safety and showing up for work and attendance and all of those things, he's a good employee," Morton said.

Morton said his company performs random drug tests on employees. Drivers are subjected to inspection before starting their shift, he said.

Just how long Pestana had been drinking while behind the wheel is unclear.

"Public safety is our first concern. We take drugs and alcohol very seriously. We don't tolerate their use in the workplace," Morton said.

OTS suspended Pestana without pay. He is scheduled to appear in District Court on Sept. 26. "

DWI deaths involving motorcycles are also up -- which the patrol says is due to more motorcycles on the road, a trend Clendenin attributed to high fuel prices.

bullshit, the reason is simple .... illegal immigrants. NC is a sanctuary state for illegals to obtain insurance, drivers licenses and other documents. hopefully with the new DL centralized system some of the falsifying documents will be cut back dramatically.

^^I'd hate on the state before the illegals. Illegals are going to drive with or without a license. How many times can you get a DUI in this state? How many times is the sentence reduced in court effectively getting rid of the punishment? I recently heard a story on WRAL (IIRC) where they reported that of 60 some odd DUI tickets they handed out during one of their crackdowns 40 or so were dropped before they went to court. What does this state do with repeat offenders? Repeat offenders would drive with or without a license as well, but what would they do with them when they are caught?

I'd like to see a few statistics. Of the cases that ended in someones death, how many were repeat offenders, under the legal age, illegal immigrants, etc.

To get off now the judge has to write a freaking essay why he let you off which imho makes it more of a guilty until proven innocent situation.

^ has slowback even been to court yet? if so how did he get off??

When i went to court they really had no proof i was drunk i didn't blow the field sobriety test was performed improperly (ON FUCKING GRAVEL) and on the report the police officer didn't even document my attire correctly (which there is a mug-shot to prove) and i still got rubber stamped guilty.

Yeah they just changed all of the laws to make it a lot harder to get off a DWI last year. If you blow over .08 there is not much else of a defense they could present.

yeah, considering he's riding a fucking bike around i highly doubt he got off. i can have my mom look it up to be sure if anybody really cares.

with DUI's you're guilty until proven innocent thanks to MADD. I agree drunk ppl shouldn't be driving but I don't agree that no one has any defense whatsoever. unfortunately that is what it has turned into however

As the deputy approached the car on foot, Palacios sped off with his lights off and drove through a red light, striking a sport utility vehicle carrying five Southern Methodist University students.

Palacios' car went airborne and crashed into the Clouets' SUV, crushing it and killing them at the scene, authorities said. The couple was returning from a date at the movies.

"She was a wonderful teacher and will be greatly missed," said Irma Vega-Zadeh, the principal at the elementary school where Clouet taught.

At least three others were injured, including two SMU students who were hospitalized with non-life threatening injuries.

"Many deputies said it was one of the worst accidents that they ever saw," Dallas County Sheriff's Department spokeswoman Kimberlee Leach said in a story on The Dallas Morning News' Web site. "You couldn't make out what kinds of vehicles were involved."

"He was so matter of fact about it, like it wasn't a big deal," Ward said.

The 31-year-old man was allegedly too drunk to perform field sobriety tests and was arrested on aggravated drunken driving charges, court records said.

Ward found four opened bottles of beer in the car, court records showed.

It was the man's sixth DWI arrest. He had been found guilty of four of five previous drunken driving charges and has paid $1,750 in fines, the DWI Resource Center said."

Raleigh, N.C. — One man died in a wreck early Thursday along Leesville Road, police said.

Police said the vehicle was traveling north on Leesville Road when it left the right side of the road, struck a utility pole and flipped, police said.

Daniel Robert Esmond, 38, of 4109 Lake Lynn Drive in Raleigh, died in the 2:25 a.m. crash. Esmond was traveling in a vehicle driven by Anthony Joseph Caggiano.

Caggiano, 20, of 11901 Appaloosa Run in Raleigh, was injured in the incident. He has been charged with felony death by motor vehicle, driving while impaired, provisional driving while impaired and careless and reckless driving.

The wreck caused limited power outages in the area. Progress Energy reported that it had more than 325 customers in Raleigh without power, but service was restored later in the morning.

Crews had to wait until a new utility pole could be brought in before reopening the road. The damaged pole connects to two man feeder lines, so crews couldn't cut it down without shutting off electricity to 8,000 customers and stop lights at several major intersections, authorities said."

^^ I will bet good money that happened in front of my parents' house. They've had 6 drunk drivers crash in their ditch since living there. They even had a cop smash his patrol car in front of their house. We think that section of road is built on an Indian burial ground

Wake Forest, N.C. — Authorities charged a Wake Forest woman with driving while impaired Wednesday after a car sideswiped a school bus carrying 35 students to Wakefield High School.

Troopers also charged Melody Parsons, 42, with careless and reckless driving.

The crash happened at 6:35 a.m. near New Light Road and N.C. Highway 98. Troopers say a car crossed the center line on New Light Road and struck the bus.

School officials identified the bus as No. 565.

As a precaution, emergency crews took seven students to WakeMed North with minor injuries, according to Wake County school district spokesman Bill Poston. All of teh students were treated and released.

A second bus picked up the remaining students at 8:10 a.m. and took them to school.

Parsons was listed in good condition at WakeMed."

I just had the opportunity to convict a drunk driver while serving jury duty today. I'm glad I had the opportunity, and I'd do it again. It was his 3rd offense, and they put him away for 2 years.
