well, given how the prosecution intentionally delayed giving the defense access to the computer or the GMS evidence until after the records would have been wiped, it's a sure bet that the time for subpoenaing other records that could exonerate BC had also expired. it was a dirty fucking trick played by the prosecution, but they can hide behind "uhhhh, our guy was out. sorry *sheepish grin*" and be safe.

Yes, when you know the zip code of what you are looking for. How does this guy know the zip code of the address where he wants to dump the body before he looks for that place? Yes, if you are familiar with a location, you *might* be able to get there relatively quickly, depending on how fast your connection is and how little else there is to distract and confuse you in the satellite view. It's easy to find shit in the map view. It's a whole lot harder to find it in the satellite view. Now, try to find a good place to dump a body in the satellite view (which probably doesn't even have up to date satellite imagery), and do it in less than 41 seconds.

They filed minutes after the verdict was read. A new appellate attorney has been assigned. They have to wait for the transcript to come back from the trial court. Then they will file a brief, and the attorney general's office will file one in response.

Actually, could be as long as 18 months to 2 years. And you can't really speed up the transcript, the person has to type up every single day of a 10 week trial. It takes forever.

Usually it's just one I believe, and it takes about 6 months to get the transcript for a trial of this length. It's not her/his only task.

Aaaaaaand a mistrial declared in roger Clemens perjury case because the prosecution let the jury see some inadmissable evidence... portions of some video evidence.

SOUND FUCKING FAMILIAR?

In Clemens case, no curative statements, AND a hearing sept 2nd to determine whether jeopardy attaches.

If that's not some horse shit for brad cooper...

If they decide the prosecution did it intentionally, then double jeopardy should attach. Which is honestly what should have happened in Cooper. Intentional prosecutorial misconduct = mistrial with no retrial.

I don't think the defense asked for a mistrial at this stage of the game though. I thought that came later? I can't remember.

The difference is pitching quality. Cooper could only get a router into shallow water, where boats can hit it.

^^Unless they were specifically trying to cover something up. CPD didn't have to send those computers to the FBI, they chose to. And like 2 weeks after they had seized the computers. And in the mean time, they say they never even looked at them. Can you believe that? I can't. You've got computers in a high profile murder case, where the guy is a techie, and you AREN'T looking in them? BS.

i mean, really... This is a random murder case in Cary, NC. Why the fuck did the FBI need to get involved? based on the other scummy shit the DA's office did in this case, I wouldn't be surprised if they did it just so they could claim "national security" in order to further fuck over the defense. It's a beautiful idea. "Hey, we can object to everything they ask because they won't know anything about it. Oh, and we won't let them know anything about it, cause it's 'national security!'"

The DAs argued that it would be a national security problem for them to turn over how the FBI got the results they did from the Cooper laptops. So, even though every other agency is required to turn over bench notes, lab notes, evidence logs, mechanisms, etc... they argued it would be a national security threat for the FBI to have to turn over the same thing. It would apparently allow millions of people to exploit child pornography. They didn't even get the results of a TEST performed on the machine, with the Cooper data to it.

And the judge bought it, so... nothing but the end result of the tests for the defense. Basically "we say it's this way, just trust us how we got there, even if it doesn't make sense."
