i rarely eat anywhere that gratuity is included for that very reason, because the service usually sucks, i eat a lot of places where the ~15% tip is over $25 for two people because of the price of the food, but the service is usually excellent, and its my decision

Pope claimed that they had to wait nearly an hour for their order and that she had to get napkins and silverware for the table herself.
“At this point I became very annoyed because I had already gone up to the bar myself to have my soda refilled because the waitress never came back,” Pope said.
After the $73 bill came, the group paid for food, drinks, and tax but refused to pay the tip. After explaining the bad service to the bartender in charge, Pope claimed he took their money and called police. The couple was handcuffed and placed in the back of a police car.
“I understand that, you know, we didn’t pay the gratuity, but it was a gratuity, it wasn’t something that was required,” said Wagner.
The owner admitted that the group waited unusually long for their food, but said the pub was extremely busy that night. He said managers offered to comp the food, a claim the couple denies ever happened.
“Obviously we would have liked for the patron and the establishment to have worked this out without getting the police involved,” said Deputy Police Commissioner Stuart Bedics.
Police charged them with theft since the gratuity was part of the actual bill. However, it is doubtful that the charges will hold up in front of a judge. The couple is scheduled to appear in court next month." |

When I was a waiter, we had the option of adding a mandatory tip onto the bill. We usually never did it unless it was a huge table/ order... or you just thought a motherfucker wasn't going to pay you. We also has a sign post3d that said tip will be added to a table of 12 or more.

I heard about this on the way in to work this morning. I caught myself thinking... I don't view myself as being the type that would sue for petty crap, but I just might have to if that were me.
So they robbed the restaurant because the tip was a part of the bill. Wasn't the restaurant stealing from them by charging them a premium for a service that wasn't adequately provided? Seems like it would be hard to establish a contract when the restaurant didn't make good on their end of the deal.
So you hear about these stories all the time. Solution? Everyone go to the restaurant and dial 911 when the service sucks.

In legal terms, "service" just means bringing them their food and beverage
It speaks nothing to the quality or timeliness of these actions

if it's written on the menu, to be x% gratuity added for parties of y or more, if the customer orders food, they've accepted the clause in the transaction.
hence, not stealing and the customer has agreed to abide by the clause by placing an order and not deciding to go elsewhere.

i went ahead and paid the bill, leaving a good tip
the waitress then proceeded to completely ignore us until we left
i disputed the charge on my card, and they didnt get paid
