i rarely eat anywhere that gratuity is included for that very reason, because the service usually sucks, i eat a lot of places where the ~15% tip is over $25 for two people because of the price of the food, but the service is usually excellent, and its my decision[Edited on November 20, 2009 at 10:22 AM. When I was a waiter, we had the option of adding a mandatory tip onto the bill. We usually never did it unless it was a huge table/ order... or you just thought a motherfucker wasn't going to pay you. We also has a sign post3d that said tip will be added to a table of 12 or more.Never had any issues... but yeah, I'm sure that shit would never hold up in court if a restaurant patron decided to take it that far.

I heard about this on the way in to work this morning. I caught myself thinking... I don't view myself as being the type that would sue for petty crap, but I just might have to if that were me.So they robbed the restaurant because the tip was a part of the bill. Wasn't the restaurant stealing from them by charging them a premium for a service that wasn't adequately provided? Seems like it would be hard to establish a contract when the restaurant didn't make good on their end of the deal.So you hear about these stories all the time. Solution? if it's written on the menu, to be x% gratuity added for parties of y or more, if the customer orders food, they've accepted the clause in the transaction.hence, not stealing and the customer has agreed to abide by the clause by placing an order and not deciding to go elsewhere.dont be silly.
