Instead the victim will probably be permanently crippled.

And the victim was in jail because was drinking a 40 in public.

You need to work on really cramming the gobsmack into the headline though

Beaten To Death in Prison For Drinking A 40?!!

You need to be the first in print, so don't worry if he's not dead yet. The question mark absolves you.

He'll have to learn to stand up again first if he's going to be wearing pants. I guess the next sidewalk he drinks on will need a ramp.

not for nothing, but why are we jumping to conclusions?

i know this could be what happened, but couldn't it be the other way around, too?

why do we instantly assume the inmate is innocent, and the officer was the aggressor? why do we instantly assume the inmate is a little angle? Just because his offense was petty, being incarcerated makes inmates act out.

I have worked in both jails and a Federal Pen, and I can assure you that inmates are often dangerous, unpredictable, and violent.

I can also say that inmates do in fact assault and attack officers, often with handmade weapons, bodily fluids, used insulin needles, cleaning chemicals, or brooms

I can also say that every inch of a unit is under video monitoring, so that incident is no doubt pretty clear cut either way on tape.

I can also say that the officer in a housing unit is outnumbered by at least 60 to 1 at any given time, and is usually in the unit by himself with inmates free to walk around the day room.

why exactly is that funny? i am familiar with prisons as well, moreso than jails, so i can't attest to everything he said, but it fits with what i know of penitentiaries.

i can say that often the inmate population is a reflection of the guards and the method in which they are incarcerated. if you have a group of guards who show more respect to the inmates and don't try to punish them, then often you get positive responses. while it is entirely possible the guard used too much force (whenever someone ends up with a broken neck, you have to wonder), the circumstances should play themselves out before we jump to conclusions either way.

this kind of shit happens all the time with news stories...a little information, one side of the story, and then the perspective is forever tainted. the duke lacrosse case, trayvon martin, joan allen in "the contender"...the truth is always better served with patience. if there's reason to be outraged, we can always do that later.

i can also say that the floor of a housing unit is made of solid concrete, so if the inmate was taken to the ground, as is pretty standard use of force, and happened to hit his head wrong, it could cause a head/neck injury without intention.

Also

Quote :

Its usually the more petty offense guys, or mentally ill, who act out anyways. Some of the most hardcore felons i met in the Fed, were the most polite and respectful. Guys who knew they were going to die in there, tended to be the ones who wanted to get along and keep things running smooth. They have been there for decades, and will be there for many more, so its their home and they want it laid back. The younger guys, with 5-10 max, tended to be the hotheads with something to prove.

Somebody is going to get the guilt trip of a lifetime for not bailing him out. can you imagine waiting in jail for a fucking drug paraphernalia and public consumption charge for over 3 weeks? Most people are released after less than 24 hours for that kind of bullshit.

Hopefully there were cameras in the unit that could see what happened clearly. I've worked in two different jails in North Carolina and most of the units I have worked in, there are areas that are not covered by camera. Alot of areas, actually. As an officer, I want justice to be done no matter who is at fault. If this officer showed too much force, I hope they go after him. I don't want dick bags like that giving my profession a bad name.

Also, Theoretecht, this isn't Raleigh PD. The Sheriff(county) always runs the jails. This would be Wake County Sheriff's Office that would pay for it. Your hate for anything Law Enforcement shows through though, so I'll let it slide.

Like Fuhctious and Knarf both said, the hard criminals(murder and the like) are the ones that you don't have to worry about. The mentally ill that come in every other week are the ones that act out. Those guys you need to keep an eye on.

http://www.wral.com/wake-detention-officer-indicted-in-inmate-s-death/12747219/

Quote :
"Wake detention officer indicted in inmate's death

RALEIGH, N.C. — A Wake County detention officer was indicted Tuesday on a charge of voluntary manslaughter in the June 17 death of an inmate at the Wake County Detention Center.

Shon Demetrius McClain, 40, died from blunt force trauma to the head and neck 13 days after, the Wake County Sheriff's Office says, he was involved in an argument with officer Markeith Council.

Council, a detention officer at the jail since 2009, was initially placed on administrative duty pending the outcome of a review by the State Bureau of Investigation and a decision on charges by the Wake County District Attorney's Office.

A spokesman for the sheriff's office said Tuesday that Council has since been suspended without pay.

McLain was in jail awaiting a court date on misdemeanor charges at the time of the June 4 assault.

According to an investigative report by the North Carolina Office of the Chief Medical Examiner, McClain punched an unnamed prison guard in the face during the argument after the guard shoved him.

The guard then threw McClain to the ground twice, but the report says McCain appeared to be unconscious after the first throw."

Donnie Harrison and Colon Willoughby really are two top shelf pieces of maggot infested shit

Colon is going for the lowest charge possible and he knows it, he hates charging any law enforcement officer with any crime.

Back several years ago, Donnie Harrison had a policy in place where all persons accused of a crime be arrested and processed. This policy changed when the kid died in his jail and the kid's rich grandfather lawyer was considering a lawsuit.

Donnie Harrison is a truly evil man with some scary skeletons in his closet

That's pretty hard to watch. They guy knocks the inmate out with the first slam, then picks his limp body off the ground and slams him headfirst into the ground. Voluntary Manslaughter huh. Fucking bullshit.

Here's the N&O article from today
http://www.newsobserver.com/2013/12/10/3450233/wake-prosecutor-plays-video-of.html

Quote :
"Another inmate, Aaron Mitchell, who has prior convictions for felony larceny and marijuana possession, said he heard Council tell McClain, “I’ll beat you to death, and I’ll take my time calling the nurse.”"

I don't know how much weight a jury would put on the word of inmates, but the unfortunate part is there's no audio in the video, and Council was the only officer present at the time.

Also
Quote :
"Council’s attorney, Craig James of Smithfield, did not dispute the video. But at day’s end, he asked Judge Paul Gessner to dismiss the voluntary manslaughter charge because the statute indicates a person guilty of the crime must have committed the act with an intent to kill with malice"

The judge dismissed this, but even as a layman I understand the definition of manslaughter. So how is it a lawyer in a manslaughter trial can argue that having no intent to kill with malice disqualifies this as manslaughter?

voluntary manslaughter requires malice aforethought. you're thinking of involuntary manslaughter.

In the end, the guy did assualt the officer, and even after the first slam apparently the guy's body went though some throes so the officer could take that as another threat. I totally side with officer here.

He attacked the officer, or am I blind? Whether is succesfully landed a blow is not the true debate. Put yourself in a the officer's shoes - that is a SCARY job and when you have a situation that escalates while you the only guard present ... just think about that for a moment and tell me what would you do. YOU DON'T KNOW WHAT YOU WOULD DO, THAT IS THE ANSWER.

I think you may confused. The officer is the hulk in black who sends the victim (who is kinda hard to see since he's dress like waldo) sailing across the room before he breaks his neck by picking him up and slamming him in the ground.

The 'victim' assulted the officer when you got with 6 inches of him. Walk up chest-to-chest to a police officer on the street and see don't you get hit with something or arrested.

I doubt he would scrape up the dude's limp body off the ground and them slam it headfirst into the ground again.

He might be able to defend his actions with the first slam, but not the second one.

Getting in someone's face isn't the same as assaulting them. I'm pretty sure I would have a good lawsuit on my hand if a cop cracked my skull open based on the fact that I raised my voice and invade his personal bubble.

Look, I get what you all are saying, but what consitutes and assult BY the inmate is the question that is gonna lead to the settlement of this trial. YES the inmate assualted the officer FIRST. That is what I am seeing.

Well, I did not say that was the only thing that would settle this case. Anyway, the officer should not serve a day for this. Its very unfortunate for the poor guy, but he provoked the situation and I think the officer's reactions were warranted. On the second slam it does kinda look like the inmate is moving or maybe trying to get up.
