I have a few air line attendant friends that are standing on the side of United in this...

I can't see how, no matter how I look at this situation I can't fathom how this could happen.

I would sue till I owned a % of United.

the link below has things i did not see before:

- video of him running back on
- video of him saying "kill me" repeatedly
- united ceo apologizes in public with the "re-accommodate"
- but congratulates all in private for going above and beyond in doing a great job
- united stock falls 3%
- details about victim (wife doctor too, and so are 4 of 5 children, and more)

I read the CoC before reading this, and my interpretation also was that United was in breach by attempting the remove the passenger for a reason other than the "allowed" reasons stipulated in the Contract of Carriage, which don't include wanting to fly their own employee. They can't un-board a passenger because they want to board their own employee. However, the contract of carriage doesn't define boarding explicitly, so United might try to make an argument here.

This asian guy is going to get paid I predict...

Exchanging drugs for sex just makes the guy more relatable.

I mean, we kinda already knew his talk game was weak...seeing how he got dragged off the flight and all.

If what this article says is correct, then I'm 100% wrong in all of my previous analysis of this situation.

The sites reporting this had the wrong person. He wouldn't have a medical license if he was arrested for pushing pills.

Guy, his wife and 4 of their kids are apparently squeaky clean doctors...

Ha ha ha, it's not even him who has the sordid past, just a guy with a similar name. Lawsuits everywhere for this man.

It's not, but it's nice icing on his forthcoming lawsuit cake and an extra lesson in why United should have handled this better

I do have one question though. Are we sure it was United who physically removed the dude from the plane? Seems like that would have been security or the police who probably aren't employed by United. Seems from what I have been reading United was pretty much required by law to bump people off in this instance. I have no idea how much they went through to try to resolve this peacefully before security was called to remove the man. If they followed all their procedures should we really be upset with United or more so at the people who beat the guy up to remove him from the plane?

I think that the people who removed the doctor from the place were actual air marshalls. Given, I don't know everything that happened, I actually place the absolute LEAST blame on the air marshals in this situation. I mean, from their perspective, they just get a call to remove someone from a plane...and their job is to do that. It didn't look like they punched the guy, or did much other than break the doctors grip on the seat and drag him away.

I mean, fuck...when you see the guys with blue coats, badges, and guns on their hip come for you... you're somewhat in control of your own pain there. Again, I wasn't there...but I feel fairly certain the marshalls said something to the effect of 'aight, bruh....we can do this the easy way or the hard way. Are you going to get up for us?'

It's just on Twitter, currently.

I'm not sure anyone here actually thinks it was United Employees who dragged him off the place.

Yes, because United called in the cavalry to drag this dude off the place. Their policies and decisions caused the situation.

Yea, and I still think the boarding=/ deplaning argument is weak. However, that article gives pretty good credence to contract law, and because the United Contract of Carriage makes a distinction then that argument must exist on some level. Further, United acted in breach of that contract as he understands it. So... I'm willing to admit when a valid source has shot me down.

I'm not sure I should have been condemned to death for speaking my opinion though. Seems ironic in hindsight.

I'm so confused... this dude wasn't born with the enalienable right to a plane ride. Why couldn't United have just said "sorry sir here's your money get the fuck off my plane?"

I don't understand how the conversation has moved passed. Dude should have gotten off plane when directed.

^^^^ I would disagree the "calling the Calvary " caused the situation as they were called as a direct result of him refusing to GTFO

Of course you do... but only because that's good business. As long as you get your money back, there's no "legal garuntee" to your seat. You assume you'll get your seat because a company that had that shitty of business practices would go out of buisiness. Not because you have some divine right now.

Give Asian dude his money back. Tell him tough fucking luck.

I hope the next time ssclark gets a haircut, the barber drags him out of the chair, keeps his money, and tells him he has the right to refuse service to anyone.

Or the next time he goes to Subway, I hope they snatch his footlong out of his hands and kick his ass to the curb without giving him his 5 dolla back.

Ssclark, once the money is exchanged that seat is essentially yours, you've entered into a contract. This seems like the most basic business principle. Like just imagine the chaos if anyone could break a contract at any time just by returning funds.

If you rent me a house and I pay first month rent and move in, if you come by the next day with my cash and tell me to GTFO expect me to tell you to fuck off

I mean to further the airline scenario, at what point would you consider the seat "owned" by the customer? Imagine I have a layover, should the airline be able to just refund all or half and leave you sitting in an airport??

^^^ didn't read what I said eh?? Don't be a fucking moron. I clearly said they needed to give him his money back.

Although yes I agree with you, stealing is wrong and I'd be upset if subway stole from me.

Ok I take it back. It would seem there is infact a law that makes planes like counteries i that once you're on the plane you're golden. There fore... Asian dude gon get paid

you put forth a scenario that business should be able to rescind goods at any time they please, i said "no they shouldnt be able to do that," you respond with "oh so businesses can never rescind goods??"

you edited but to sue or not to sue comes down to whether there was damage. it was my understanding that the united flight was the last one of the evening, hence why united was willing to pay money to get their employee's onboard.

for the roofing analogy, how about if you have a massive leak and choose roofers and this guy is first available, with some other that could start shortly after. You choose him b/c he can start earliest then later he rescinds his offer. at that point your other options have pushed their start date and your roof leak proceeds to cause more and more damage. I could def see a court case in that scenario

They just can't get a break

http://metro.co.uk/2017/04/14/man-stung-by-stowaway-scorpion-on-united-airlines-flight-6574417/
http://metro.co.uk/2017/04/13/grandma-94-forced-out-of-business-class-seat-on-united-airlines-6572771/

And this is an interesting development:

http://metro.co.uk/2017/04/13/united-airlines-refund-every-single-passenger-on-that-flight-6571891/

Quote :
"United Airlines will refund every single passenger who was the plane when a doctor was injured dragged off by airport officers in Chicago.

Hoping to resolve the incident and resulting backlash, the company also announced that it would no longer ask police to remove passengers from full flights."

Has the CEO finally come to his senses, or is it the bottom line speaking?

Quote :
"In an interview with ABC’s Good Morning America, United parent company chief executive Oscar Munoz said he felt ‘ashamed’ watching video of Dr David Dao being forced off the jet.

He has promised to review the airline’s passenger-removal policy.

Mr Munoz, apologised again to physician Dao, his family and the other passengers who witnessed him being taken off the flight.

‘That is not who our family at United is,’ he said. ‘This will never happen again on a United flight. That’s my promise.’

In the future, law enforcement will not be involved in removing a ‘booked, paid, seated passenger,’ Mr Munoz said. ‘We can’t do that.’"
