NCSU Student Charged with Rape

(10/18/05 - RALEIGH) - An N.C. State Univeristy student is at the center of a campus rape scandal.
Charles Bryan Davis, 19, of Clinton, has been charged with raping a woman during a Sunday night party. He was arrested Monday and released after posting bond and agreeing not to have contact with the victim.

Investigators say the victim was intoxicated. Davis lives on campus at
Bowen Hall.

no if the guys drunk then they look at the timeline to see who is the most drunk and who was drunk first

Depending on her level of intoxication she can give consent..just b/c there is alcohol in the blood doesn't mean she is drunk.

Possible he did harass her into having sex, or "sexed" while she was unaware....but there is the possibility that she did give aware consent, but under the influence wasn't aware of who he was..then later regreted it and yell raped.

If he used a condom..she should leave it alone..this is college..she's probably had sex before..just didn't want to admit that she did with him, so before he went out braggin, she cut him down.

How do they know 100% that she was intoxicated when the alleged rape took place? Did they take a breathalizer of her right before or after she was raped? if there were witnesses how do they know she wasnt just acting retarded and silly?

First off, I'll say that rape is a horrible thing. Wow, surprise, I know.

Secondly, I think it is too easy for woment of accuse someone of rape when even if the charge is found false, a lot of things would change for the guy. Especially if it goes to trial and the man is found innocent, he might as well be found guilty without a prison sentence because who wants to trust an accused rapist? Nobody cares at that point that you were found innocent, it's that you were accused.

I feel bad for rape victims, I feel worse for wrongly accused men.

First offense is just to signify that the person was helpless...

They must have some pretty damn good evidence to charge him with both, which if it goes to trial will basically be his word vs. hers, and who do u think they will beleive? a 20 something college male or a 20 something college female who is sobbing on the stand?

they also have rape kits...which i'm sure she had done after she called the police, if not before, at a hospital. so that would also be evidence.

^^^^Rape isn't just a "bad experience" and it probably has the potential to ruin someone's life as well. The difference is that rape harms the victim, while jail time harms the person who actually did something wrong.

bad experience =/= rape

bad experience is when the sex lasts a minute or hes 4inches (hard) or you dont come, it is NOT when you are RAPED

Its so that they are not harrassed by assholes like the people posting on this board. Sexual assault victims always have their names withheld by the press to protect their privacy. It takes a LOT of courage to come forward and say this happened to them.

Unless you were in the room with those two then you do not know what happened so how do you know that they were willing or not?

It is not fair that women are required to make sure that they do not dress to intice, make sure that they do not drink and avoid situations that may put them in danger because of men when in reality MEN should think before they act. If the guy was sober and the woman was not then he should have driven her home.

Yes it is wrong to accuse if nothing happened and ruin someone's life but otherwise let the court decide. We do not know what evidence they have against this guy or anything else so why don't you all just leave it the hell alone.
