Is it illegal for a 16 year old to have drunken sex with an 18 year old?

P.S. the 18 year old got up and threw up twice during the sex, and he has some sort of weird rash so he kept his shirt on.

^^ sounds like you didn't enjoy it all that much. and as far as i know in NC it's the 3 year rule if they're under 18...either that or 16 is the age of consent. i cant remember. if its the 3 year rule, then if you are 19, the other person has to be 16 at a minimum but if you are 18, then they can be 15.

And drunken sex is the best kind of sex for getting you into all sorts of trouble. If she says rape, the law will automatically be on her side, even moreso because they'll say she wasn't sober enough to make a judgement call.

16 is the age of consent in NC (That three year rule is complete bullshit). However as has already been mentioned, if the girl was drunk and decides to claim rape, the ages of the two parties doesnt really matter.

In NC when a girl reaches 16 she is 100 percent legal for any man of any age. Before 16 the 3 year rule is in effect. I am positive on this because I had it in a law class.

Depends on the state. Most states have "Romeo and Juliet" statutes that allow a certain window of age differential.

For all of those discussing the age difference stuff, the information is incorrect. The age of consent in NC is 16. The only part of this law where difference of age comes into play is in the severity of the felony that one is charged with for having sex with a 13,14, or 15 year old. A person that is 16 is legally allowed to consent to sex with a person of ANY legal age.

^ Can you cite the statute that mentions the 4 year rule? When I worked at the state legislature we had this argument when we were bored and we never found anything that mentioned a 4 year rule. The only part where the age difference comes into play is when determing the severity of the felony.

the 4 year rule applies in several statues. Like is GS 14-27.2 first degree rape if the victim is 12 or under and the suspect is 4 years older then its first degree.

Like someone said in NC the age of consent is 16 end of story. In most states the age of consent varies from 16-18. What I think is odd is that in some states the male only has to be 16 to have sex but the female has to be 18

turn to page 14 of that pdf link i posted to see north carolina on the chart. north carolina has n/a for the minimum age which means anybody can have sex legally within 4 years and anything goes once both parties are 16.

something i just found out is that anything also goes if both parties are under 12 because 12 is the mimimum age to prosecute in nc

Yes, 16 is the age of consent in NC. It's a little more complicated if the girl is a retard, you're in a position of authority(teacher), or if alcohol is involved.
