Quote : | "CRIMINAL CONVERSATION - Obs. This phrase was usually employed to denote the crime of adultery.
The remedy for criminal conversation is by an action on the case for damages. That the plaintiff connived, or assented to, his wife's infidelity, or that he prostituted her for gain is a complete answer to the action. But the facts that the wife's character for chastity was bad before the plaintiff married her; that he lived with her after he knew of the criminal intimacy with the defendant; that he had connived at her intimacy with other men;, or that the plaintiff had been false to his wife, only go in mitigation of damages. The wife cannot maintain an action for criminal conversation with her hushand; and for this, among other reasons, because her husband, who is particeps criminis, must be joined with her as plaintiff. From Black's Law Dictionary
Quote : | "criminal conversation. Archaic. A tort action for adultery, brought by a husband against a third party who engaged in sexual intercourse with his wife. • Criminal conversation has been abolished in most jurisdictions" |
you sue a third party for seducing your spouse. Sorry that other source is just kind of bad. f'n google! This was necessary because back in the day it was very hard to obtain a divorce. So a proven claim of CC would make it easier to get a divorce.4/14/2006 1:29:19 AM |

To the best of my recollection it's still on the books in NC.
Now here's another part: is the only reparation/punishment monetary? Say, perhaps, the defendant has no or very little money or possessions...what kind of recourse can be taken? Jail time? 4/14/2006 1:54:24 AM |

So are you the adulterer or the adulteree?
No jail time as was mentioned, but remember civil judgments in NC are good for 10 years then can get renewed for another 10... 4/14/2006 9:36:32 AM |

People were like WTF.
Im glad I knew that crap like the back of my hand. Like someone said before though. Its only for $ damages. It is still of the books though.

This guy is slick. He won't have any taxable or reported income. Maybe I oughta put a PI on his tail and get him sent up for tax evasion. 4/17/2006 11:21:09 AM |
