Did anyone happen to see this? It involved a yellow Jeep Wrangler and a blue car.
I was going through the green light driving towards downtown and the guy turned right (on red) from Dan Allen to Hillsborough. The problem is that he started turning as I entered the intersection, so I slammed on the breaks and slid into him.
He claims that he had a green arrow. So the police report says that both of us claim to have a green light. The officer told me that he believed my story, but the report won't say that. The guy is also "self-insured," but from NC, which I thought was illegal.
He also claimed to have looked left before turning, but there is no way. I could easily see him the entire time.

Doesn't matter, you will win any dispute, he has to yield to oncoming traffic. If it comes down to an argument of who had the green light, you will win it in court.

these no way he could have had a green arrow and you had a green light.
for him to have had a green arrow (if they even do that at that light. hint check into that) the the west bound traffic would have had a left turn arrow, which meant you would have been running a red light.
if the officer puts that both of you had a green light...then its bullshit on his part, maybe he's being lazy i dunno...or maybe hes the switzerland of the raleigh pd.
it sounds like you had a green light, and that guy didn't check before infringing on your right of way. i would talk to student legal (assuming youre a student) and tell them the story. be sure to bring the report.
but yeah, like noen said [unless you ran a red light ] he infringed on your right of way and its his fault.

Ya I happened to see the two cars in the morning. The blue car had some damage, didn't get a clear look at the Jeep though.
^^There is no right turn light at that intersection. So clearly that guy is bull-shitting.

I think that she was saying that the cop wrote that both drivers claimed to have green lights. The cop didn't see the accident, and there were no witnesses. So he has to write his report based on what the drivers say, and the physical evidence at the scene. 8/31/2006 2:04:52 PM |

There IS a green arrow at that light......
but you obviously had a green, that guy is covering his tail. You also cannot turn right on red on that light period, so he should have a ticket on top of the wreck. Tell him to think of a better lie. From what you're describing, you got him on the driver's side? Was he injured? And, oh yea, pray he has insurance

either way, its his fault not yours no matter how you put it even if the light was not green im pretty sure that there is a no right on red sign there 8/31/2006 2:13:58 PM |

No one was hurt. My right front fender hit his left front fender. He called a tow truck and I was able to drive my Jeep to the deck.
My fender is pretty busted on that side, but at least my Bulletproof front bumper is still fine. Also, something is horriblely wrong with my steering, but that seems to be about all of my damage.
It's just aggravating because when the cop came is when he first said that he had a green. I just stared at him because I couldn't believe that he would so baltently lie to keep from getting the right on red ticket. 8/31/2006 3:58:23 PM |

That intersection has a NO TURN ON RED sign for Dan Allen cars, so he shouldnt have been making a right turn on red, and its kinda obvious that you have green (and therefore he couldn't have had a green arrow) If you had been running a red light you would have hit someone turning left from DanAllen unto Hillsborough and he would have had a solid green light (not an arrow, that only pops up after Dan Allen has had the full green light cycle).
There is a reason why that NO TURN ON RED sign is there, today only proves it. 8/31/2006 4:17:25 PM |

^5 I don't see where you would have to yield to anyone if you are making a right turn on a green arrow. I'm not agreeing as to whether or not he did.

that's a good point. If he had had the green, his left hand lane would have also had the green, and you would have certainly hit them first, unless their was no one in the left lane which would be a one in a million during 9-5. 8/31/2006 4:42:31 PM |

The left turn lane from Dan Allen to Hillsborough was full of people.
As soon as I saw the guy pulling into the intersection, I tried to stop, but knew that I would probably hit him since the road was wet and I only had 20 ft max. I was worried about bouncing off his car and hitting the car to the left of me as well, which I told the officer as further proof that my light was green. I'm still waiting for my insurance guy to get in touch with me. 8/31/2006 4:48:09 PM |

This is why, when you see an accident, you should stop (unless you're on the way to a hospital or something) and give a witness report to the police. I guess most people can't be bothered.
I witnessed a very bad accident at Dixie Trail and Wade Ave in July. It involved an SUV flipping after hitting another car. One of the drivers had to be snipped out with the jaws of life, so the damage was pretty significant. The car on Dixie Trail definitely had the green (I was two cars behind her), but I seemed to be the only one who stopped to verify her story. I'm sure the SUV lady on Wade also said she had green, so I'm glad I waited the 15 min for the RPD. The SUV driver's insurance company then proceeded to call me to ask for another statement. I just asked them to refer to the police report. Other than some guys doing yard work, no one else stayed around, and there must of been at least a dozen people who saw it. Pretty lame. 8/31/2006 9:39:57 PM |

^Actually you don't have to wait for the police, just give the person your contact info.
Their statements should be enough for the insurance companies

Let's just say that this isn't the first time someone has turned into my lane when I clearly have the right of way.
In December, it wasn't even at a light or anything. The girl just decided that it would be fun to drive right across Avent Ferry as I'm driving down it.
It's not like my Jeep is hard to see. . .

RPD = "unable to determine fault"
so of course i never got paid for the damage to my car. that shit sucked, i havent thought about that in years.

You are screwed. I (along with a few others apparently) have had almost the same thing happen. I was going through a green and the other driver ran a red light and clipped the front of my truck. No witnesses stopped, he told the cops I was the one who ran the red light. No one was issued a ticket and my insurance paid for my car (less deductible), his insurance paid for his (if he had full coverage). It sucked, that asshole cost me 500 bucks. If you can't find a witness I almost guarantee the same will happen to you. 9/1/2006 3:39:17 AM |

Quite a few years ago, my dad was sitting at a red light in the rain, and some jerk tried to speed through a yellow, that turns red and slams ont he brakes and slides into my dad who is still sitting still. The cop called it NO FAULT, because my dad was in the guys lane of travel (which he was in the other road continued another 30 feet into the intersection), total BS.
and btw, atleast 20 people had to have seen it, and no one stopped. 9/1/2006 7:07:16 AM |

I doubt any witnesses you found now would be helpful. There wasn't anyone at the scene who was documented by the police officer as being a witness. The other side can argue that you just went out and asked a friend to side with your story after the fact.

yeah, there is a NO TURN ON RED sign for that intersection, so basically he's completely screwed for taking a right he shouldn't have. What you really needed was for some witnesses that passed the straight thru light at the same time to say it was a green light in the police report. If it comes down to them saying there was a signal error, sue the city. Just hope he is insured. 9/2/2006 9:15:24 PM |
