So I got a flat tire at Zaxbys..
I pulled into the parking spot, got out and heard a hissing sound. Apparently there was broken glass in the spot and it sliced my tire (about an inch in width). I called AAA and made the manager aware. As I understand it restaraunts are liable for their parking lots. I'm going to have to get a new tire as this cannot be patched up
my question is: is it worth it to email the owner (the local franchise one) and see if I can get him to cover the cost, or do I have no chance at all? 11/12/2006 9:48:29 PM |

haha, I ended up having it changed before they got there. I just figured if they got to it in a reasonable amount of time and had it done by the time I was done eating that it would save me some time...but they didn't. AAA is pretty worthless for flat tires. 11/12/2006 9:54:21 PM |

yeah, the glass punctured the sidewall of my tire so I guess it was a cold day in Hell

You have no legal standing to ask for them to pay for your flat.
If you want to go ahead and ask and see if the guy is either inhumanly nice or hcnugyen-ish retarded....then knock yourself out. You've probably got about a .0001% chance of getting compensated. at most stores actually they do. I worked maintenance at McD's for several years and at 6 am i had to go out and sweep up trash in the parking lot, then every hour or so i was supposed to go out and do a quick scan for any more debris.11/13/2006 4:27:45 PM |

I don't know much about the legal system, but I don't see the difference between you going into a grocery store and slipping/falling due to a spill and puncturing your tire on glass. I know from second hand experience that a grocery store is liable in the aforementioned case for any injuries, so I can't see why in the world that wouldn't translate into the parking lot scenario.
I am definitely not a fan of frivelous lawsuits, but there is no reason why you should drive in a restaraunt parking lot designed for public use and be expected to pay for damages caused by shear negligence. 11/13/2006 5:16:50 PM |

I remember someone falling in front of my parents' restaurant. He was walking down the street, barely on our property. And it was pretty obvious that he fell on purpose.
