Quote : | "A day after authorities announced that a former New Hanover County deputy had been indicted in the shooting death of a Durham teen during a raid on a Wilmington home, members of the grand jury now say the indictment was a mistake.
The grand jury never intended to charge Cpl. Christopher Long with second-degree murder, but the foreman checked the wrong box on the indictment, authorities said Tuesday.
After the foreman's admission, a judge dismissed the indictment. There was no word Tuesday evening on whether New Hanover County District Attorney would bring the case back before a new grand jury next year." | http://www.wral.com/news/10519097/detail.html 12/12/2006 6:33:44 PM |

So the DA can just keep bringing the case before different grand juries until he gets one that agrees with him?12/13/2006 9:13:34 AM |

UPDATE: One of the members of the grand jury was the wife of another deputy with the New Hanover County Sheriff's Office.

I'm 50/50 on this.
The kid beat the ever living shit out of student and stole 2 playstations. There is a lot of grey about what happened at the door but this punk obviously wasn't your polite individual.
I'm thinkin some words were exchanged or maybe they were playing the stolen playstation and he shouted "kill em, kill em" and police shot him.
None of this would have happened had that punk ass kid not beaten up that guy and stole his two playstations. Lets not forget that. Sure he didn't deserve to die, but I'm pretty sure the cop wasn't planning on killing someone for stealing either. I mean c'mon.
LEts look at the facts.
1) Kid had blog with lots of hate, and gun pictures 2) Kid beat the shit out of the guy they stole the ps2's from 3) Kid stole ps2's.
This is NOT your model citizen. More like the trash of a society. He got what was coming to him, though probably years before he should. 12/14/2006 12:37:08 PM |

^Actually, Peyton (or who you refer to as "kid") was not in any of those pictures. The person in those pictures was Ryan Mills, who is the other person accused in the Playstation theft. 12/14/2006 1:10:50 PM |

If everything I have been reading is correct, the reason that the deputy shot is because he thought the officer at the front hitting the door with a battering ram was gunshots coming from inside.
I don't know how true it is, but it would explain why the boy and his dog were both shot through the door. I know the ME's report said that the bullet that killed him had gone through an obstruction prior to hitting him, and this story fits with that. 12/15/2006 4:51:47 PM |

shooting through doors isn't really the really procedural thing to do
and as far as I'm concerned he would have been justified in returning fire if he could have
but then he woulda been either dead or on trial as a cop killer 12/15/2006 4:53:39 PM |
