So i have a friend (lets say her name is Jane Doe) and she has a fiance (John Doe). They cosigned for John's brand new Jeep Wrangler. They are now on the verge of breaking up because he's been cheating on her and now she is stuck in the middle because she cosigned the car with her she doesnt want her credit going to shit. is there anything that she can do to get herself out of this? 3/21/2007 9:55:08 PM |

I replied in the other thread but just in case:
I think this exact topic has been addressed on any number of 'Judge' shows.
"Jane" needs to first, ask "John" if he will release her, I'm not sure it is allowed but she needs to at least make an effort to ask... if he says no, then I'd say she has probable cause to seek some sort of judgement against him because while it is 'anticipatory' that he will not pay, it's somewhat reasonable to assume he won't considering he won't let her out of the contract

^^ I don't think you can just get released from the note. They need that second person there with good credit in case the person with shitty credit defaults. That's the only reason he got the vehicle in the first place. 3/21/2007 10:20:14 PM |

It isn't even advisable for married people to own a car jointly.

Why would the bank release her from the obligation? It required a co-signer because presumably the guy couldn't afford the Jeep by himself. The bank has no incentive to let her off the hook unless the guy's financial circumstances have changed. 3/23/2007 2:31:59 PM |

If either of the two were a cosigner, the car wouldn't be "under her name." It'd be under both their names. If the car is, in fact, under her name, there is no problem. She simply trades it in or sells it.3/24/2007 11:03:44 AM |
