So according to Nifong, he wasn't aware at the time that he was making racially charged accusations? His attention was distracted because of his pending campaign?
I can't wait for his explanation on why he with-held the DNA evidence. My guess is that he will say it was a mistake due to his incompetence. He just didn't understand how DNA stuff works. 6/15/2007 11:21:23 AM |

he's already said he didn't know about it, then when someone said he was informed of the results, he changed to he was trying to protect the "victim". 6/15/2007 11:28:56 AM |

Well it's good he got caught and will step down.
I wonder how many other district attorneys get away with these tactics?

His disbarment sets a dangerous standard. Of all the DAs to be more or less convicted of prosecutorial misconduct he is the only one disbarred?
In the past there are DAs caught on tape committing ethics violations in capital cases, where an innocent person was sent to die, and for some reason they aren't disbarred?
We have a fucked up legal system where someone isn't disbarred in the issue of life or death and someone is disbarred for actions before trial.
The disbarment was nothing more than a politically motivated move by the NC State bar, in order to appease the national news media.

I disagree and you probably do to. His disbarment should be the standard, we should only hope that more lawyers get disbarred for unethical conduct. While I agree that there are other unjustices that go unpunished at LEAST this one did.6/18/2007 10:26:21 PM |

lawyer friend of mine told me way back when the rape story originally broke that nifong had broken ethics rules and should be disbarred from that...now the guy was a duke grad but he was pretty much on point] 6/21/2007 11:05:08 AM |

A second year law student in NC could easily pick out the rules that he broke after having Ethics. Nutsmacker is 100% correct about the State Bar's history of letting people off easy for misconduct. This will not get a precedent for disbarrment, but it really should.
It is sad that Nifong lost his license when other attorneys are still practicing after they committed worse violations in capital murder cases, just so that they could win the trial. Alan Gell's (who is white) prosecutors received a censor when they withheld evidence that he was in jail at the time the murder was committed. While Nifong was wrong in his violations, it is far more serious to sentence someone to death when you withhold evidence.
If its more important to lie and withhold justice to ensure that you win, you have no business practicing law in NC. More people should lose their license for such egregious violations
Good article explaining how nothing has changed.

^^ Excellent article. I especially like the response at the bottom from a reader :
Quote : | "I'm all for disbarring Nifong, and for making it widely known that the case against the Duke players was bogus.
But, isn't calling them "nice innocent boys" a bit much? The fact remains, these are the kind of "boys" who trade "jokes" about hiring paid sex workers and then murdering them. Not funny. Not nice. If they hadn't been living the stereotype of the debauched, drunken, thuggish jock, they wouldn't have gotten into the situation that launched the bogus prosecution.
Wait, what's that you say? We shouldn't disapprove of their legal behavior, shouldn't say that they in any way invited their persecution? Well, maybe now you understand how millions of women have felt when told that their "slutty" behavior invited rape...

As he was when he walked in Friday, he was surrounded by family and supporters as he left the detention center. He did take the time in a very brief statement to recognize the people he spent a day with.
"I want to express my sincere appreciation to all the staff at the detention center for the professionalism with which I was treated and the respect which I was shown."
As for what he wanted to do next...
"I just want to go home and spend some time with my family." " |
