i'd get a ride there with a digital camera, wouldn't call first either. there's a small chance they were dumb enough to either: 1. not find the permit to begin with 2. see it, ignore and tow, and still leave it in the car

Call the better business bureau.
Friend of mine got towed by one of the companies hired on Hillsborough St. because of predatory towing, and he called them and they sued the company and the city on his behalf. no there is a small claims court form were you deposit an amount with the court and your car must be instantly released from the tow lot for no charge...

This is what sucks about tow companies, even if they aren't following procedure they have your car so it becomes your problem to prove it to someone. Hence, they can hold your car until this happens or you have to pay then try to get the money back.

so barbours said its the properties fault, RPD said to call the taxi cab inspector in the AM, take what evidence I need... done. and handle it in court.
either way, i'll get my fucking money back. and give the towing company a headache.

1.) Print out poster-size pic of sign with you holding a measuring tape up alongside it. 2.) Save that receipt along with the towing & taxi receipts.

i really hope you just mean they filed the paperwork and sent one attorney to handle a bunch of lien claims. instead of suing the company for and the city for a total of 100 bucks and 2 hours of time. cause that's about all that's worth.

I like to drive as slow as humanly possible when a tow truck driver gets behind me. They try to play it cool when they're taking your money, but you should see how easily they get agitated when you're wasting their time. Time = Money I guess. Shit's funny though. More people should do it. Two cars, tag team, 25MPH down Avent Ferry would be nice.

i think that it's pretty iffy to do that. especially when you consider the fact that every tow company in the city is on a rotation with the police department.
they could be on the way to pull a car with murder evidence in it. or to pull a car out of a wreck thats blocking a highway.

i can't wait to see how this plays out. i'm sure he'll get his car back at no cost to him, but really its going to cause him a headache. he needs to make sure he causes as much trouble for the other parties involved as he has had to deal with. what if he needed his car today? what if he worked a late shift and needed to be at work at 3am? People need to be responsible for their actions. I think he needs to have wolf creek mandated to change all their signs and find some way to claim a loss in revenue due to lack of having a car. maybe say he didn't get to go to work today or tomorrow because he didn't have it and make them pay for 8 - 16 hours of work? 3/7/2008 10:02:43 AM |

Ok, so went to Barbours to get my car out. My fucking rearview mirror was crooked... someone bumped it. My permit was on the center console near my shifter, with the reverse side up. Someone fucked with me.
Any how, went to the clerks office. What you need to do is file a civil suit, allow the towing company three days to respond to the claim, THEN you can file that form for the release of vehicle. And it cost $75. So, what I did instead was took paperwork to file a suit for monetary damages, which i can get my car now, then pursue getting my $100+$75 back.
I'm going to deal with the apt complex now (though manager is out until monday). See if they'll knock it off my rent. If not, I'll likely slap the two of them as co-defendants for the small claims shit for the $175. As well as file a second complaint with the AG's office regarding the refrigerator not being repaired promptly, which i held off since they were extremely apologetic and made sure it was fixed immediately after talking to the manager.
Additionally I'm going to file complaints with the Attorney General's office, BBB, and the taxi cab inspector (919-664-5373)... Then at least the criminal aspect will get handled, though it will be tough to prove they broke into my car.
Called a judge friend... he said, the fact that I live there makes the sign issue a wash when pursuing the civil aspect (since I'm already aware of the towing policy), but said despite not being able to prove they broke into my car, the fact that the permit wasnt hanging, when there's really no reason to remove the tag might give me a leg to stand on. A reasonable man would not remove the tag from the mirror.

<pipedream> See if you can have the inside of the vehicle dusted for prints to compare to the tow company employees. With some luck, you might be able to get a lawyer and subpoena the employees' prints during discovery if you file suit. You make an interesting point. If the tow truck drivers prints are on the permit then that would be a huge scandal. That would also take it back in to the criminal arena, since its blatant fraud.3/7/2008 4:28:39 PM |
