the correct answer is to answer "no" or to not answer in any affirmative manner in relation to a supposed offense.
by admitting to speeding or making an illegal turn (or anything), you have waived your fifth amendment right to self incrimination and are admitting guilt.

ding ding ding. Alternately, you can ask the cop (nicely) why he pulled you over first. Keeps you from having to lie when you are asked the question, though I doubt saying "I don't know" when you know what you did would ever get you in real trouble.

I've tried everything to get out of a ticket. Denying the crime, being nice, keeping my mouth shut, asking them to cut me a break, admitting guilt to play into his power trip, etc....None of them work for me. The next time I get pulled over and the officer says I was committing a crime I'm just going to say "THE FUCK I WAS YOU UGLY POS SON OF A WHORE" and see what happens. 3/26/2008 3:40:51 PM |

I asked a cop why he pulled me over one time and he said "We'll get to that in a little bit" or something along those lines. Took him like 30 minutes of searching me and my friends to tell us that my license plate cover thing obstructed his view of the state name and "first in flight" so he couldn't tell what state my plates were from. 3/26/2008 3:43:49 PM |

i've probably been pulled over 100 times...been ticketed maybe a half-dozen. not sure what the secret is. be polite and professional, friendly but firm. keep your hands up on the steering wheel, top of door, etc, as he approaches the car. if it's dark, turn on the interior light before you do that. don't ever, ever acknowledge that you were breaking any law (i.e., no sir, i don't know why you pulled me.)

If you say "The speed limit" and he didn't really register your speed, but eyeballed it. He can't give you a ticket can he? If he tries to write a ticket, and you say "show me" and he can't produce the radar/laser with your speed, he still can't write you a ticket? 3/26/2008 3:49:26 PM |
theDuke866 All American 52807 Posts user info edit post |
yeah
he can write you a ticket for whatever he wants
and if you do something that cops don't like, but it doesn't have a specific law against it, he'll just call it "careless and reckless".
then you have to get it straightened out in court 3/26/2008 3:51:45 PM |

IIRC, the right to remain silent doesn't officially begin until you're under arrest / in custody.
meaning anything you say, or your silence, can be used against you up until that point...
Summing up Jenkins v. Anderson (1980):
Quote : | "neither the Fifth Amendment nor Miranda extend to prearrest silence, so if a defendant takes the stand at trial (thereby waiving his Fifth Amendment rights), the prosecutor can attack his credibility with his prearrest silence" |
so have fun saying nothing.3/26/2008 3:54:24 PM |

Shiiiiit. And I thought I was relatively lucky for only being ticketed 2 of the 7 or 8 times I've been pulled. Though I do agree with all of your points there.
Do you usually have a Marine Corps insignia on your vehicle, and if so, do you think that might make a favorable impression (conscious or subconscious) on the officer? Wonder if that could have anything to do with it...3/26/2008 4:02:08 PM |

He said he never gave tickets to homely / ugly women who were polite to him. In his mind, good looking women get all the breaks in the world, ugly women get few if any. He was happily married and didn't need the trim anyway.

First time I got pulled (18over)...he walked up, said 'license and registration', walked away, and then came back and said 'your court date is October 10'. Literally, all I said the entire stop was 'yes, sir'
2nd time, last week, I got pulled for expired tags, and I spoke first: "Yes, sir?" He just stared at me for a minute before asking why my tags were expired. (I told him I didn't realize they were). He took my license, sat in his car for a good 15 minutes, came back, told me when my court date is, and kindly told me how to go about getting it dismissed (which I already knew )
I figure if I get ticketed for speeding, I've got it coming, for all the dozens of times I should have been pulled, but haven't.
^^I figure if an officer even pretends to care what kind of girly excuse you're gonna offer, he'll give you a subtle opening to say it. Otherwise, it's another way to talk yourself into a ticket

eh, prob some help (i have a USMC license plate frame), though i don't think it helps much in most military towns. shit, i've been ticketed in uniform before (off base, too). Saw a cop sitting in the median facing my way and had a TOTAL oh shit moment. I laid on the brakes to slow down some...you know, just in case, but not enough to make it REALLY obvious.
As I passed him, I looked over with an face, and he laughed and gave a thumbs up 3/26/2008 4:28:08 PM |

Well I once got pulled on Pope AFB for doing 2 over, and I once got pulled on 421 for doing 70 in a 55, but it was right after the 65 / 55 change-over and the NCSHP lurks there all the time waiting for guys like me. Both times I wasn't intentionally speeding and I thought they were being overzealous but hey, whatcha gonna do?

I'd be inclined to agree, except - the insurance company would get most of my money, not the govt - taxes are supposed to be, in theory, an undue burden. And lemme tell ya...I JUST got my monthly premium under $100/mo. That's quite enough already, thank you. 3/26/2008 5:57:44 PM |

that's why you fight it in court. it costs you the same amount of money in the short run (and sometimes more), but you keep it off your insurance
and send more of the money to a traffic lawyer than to the state/county
_______________________________
haha, i've had a federal traffic ticket
ticketed twice by Pullen Park Police
tickets for following too closely, illegal right on red, you name it.
did 110 in a 45 and rode a wheelie (nobody else anywhere NEAR me)--got off with a written warning...ditto for smoking tires (twice)
been sobriety tested and breathalyzed several times (of course, i was sober. i've never once driven even close to drunk).
there is a cop in raleigh who's pulled me twice, and a sherriff in durham who's pulled me 3 times.
the one thing i've learned is that what kind of car you drive makes a HUGE HUGE HUGE difference. 3/26/2008 6:18:56 PM |
