they dont do a lot, just a little web surfing. probably email. and they cant do anything too crazy without being haker enough to get in in the first place, so i think i'll continue my free ISP

yep

our "guest" network stays open

i also log all the traffic/ARP tables in case someone looks at child porn or something
(probably wouldn't hold up in court but at least it's more than nothing)

^ what do you mean by "log the traffic" because depending on what you're logging, you may be doing something illegal (or that you could at least be sued for in our great country).

they are using my network

i pay for it

they don't have to use it

i don't see how that could possibly be illegal in any way

[Edited on June 22, 2008 at 11:27 PM. Reason : p.s. it logs the arp table plus the origin/destination/port of all traffic w/ timestamps ]

Do you make them click through a usage agreement?

Because if not, that's like if I set up a fake ATM machine, but don't tell anyone. Which i'm pretty sure is illegal...

i don't log content

i also don't advertise it as a secure service

if you set up a fake ATM, you would be defrauding people

i am doing nothing of the sort

you would be advertising a service that you did not offer

i am making no promises, no guarantees, and no statements about the quality of service nor what the service provides

therefore i am not held to any certain standard

i guess the only thing you have to worry about is what a reasonable (not tech savvy) person would think using your access point

thats really what would hold up

[Edited on June 22, 2008 at 11:35 PM. Reason : added the word person

Considering URL may contain "private" information, you should probably even only log time stamps of URl accesses.

But, in the same vein as people who have failed to use the "but it wasn't me, my wireless network is open" defense, i would bet that if someone's identity was stolen that used your network, or if someone hacked your logs and stole someone's identity, you'd be facing a lot of heat.

lol

fine

i'll put up a captive portal and make them clickthrough an agreement

CYA son... although i highly doubt anything would ever come of it

and it doesn't log the URIs, just the IPs... granted, that's not really any better... but still

[Edited on June 22, 2008 at 11:37 PM. Reason : also the logs are encrypted and only travel over my wired network]

[Edited on June 22, 2008 at 11:37 PM. Reason : someone would really have to be dedicated to get them]

actually, it's illegal to allow other people onto your wireless network and it's illegal for them to be on a wireless network that they do not belong on.

the law isn't really enforced (it has been in a few cases though).

this makes no sense at all

it may be in the AUP of the isp, but that doesn't make it illegal

Yes. Apparently people drive around in vans looking for unsecured connections and then ... uh, do whatever they do with posting child porn, I don't really know.

yeah i dont know specifically for child porn... but that would be the idea for most bad shit. find the connection, then just send what needs to be sent.

i just allow light browsing, im kinda a proxy server. even for myself, i connect to my network from outside and then surf. like from work. so work doesnt know i use the net etc

And FYI they didn't get in trouble or anything, so you can't really get punished if someone does that. But if you aren't home they might break down your door.

also when RR sends reset hax at ur torrenter

^guarantee my house/car/nose is cleaner than any cops. im never going to court again, ever. but i do appreciate the heads up.... doors arent that cheap

you should set any connected computer's download limit to a 10kb/s maximum transfer rate
