Were you being paid during those three weeks you weren't doing anything productive for them?

Economic conditions are brutal out there, so it's probably just an unfortunate coincidence that they had to lay you off after having just been off for weeks due to injury. Were you the only one let go of how ever many are in your office or were other people let go as well?

I was the only one let go, I think. (was only in the office for 90 minutes after 3 weeks out, definitely only one from my department).

The economy isn't that bad up here. NYC usually bucks the trend.

As far as being paid, the way my short term disability package worked I recieved no pay for the first 8 days and then began disability on the 9th day. I was out 3 weeks so thats only 7 business days of being paid. I don't have this money yet. I'll probably get it in 2 weeks or so. Which blows b/c due to a lot of medical expenses I only have like $100 in my checking account right now.

I'm not sure what this means? How many people are in your position?

It seems like if you were highly valued that they would have tolerated you being away as you'd pick right back up where you left off when you returned.

Not trying to give you a hard time, getting laid off sucks (I'm expecting my site to close any time in the next year), but if you're already low on expenses, going the lawyer route if you aren't sure how solid your case is might not be the smartest thing.

^no problem at all. There are 6 other people in the department with the same position as me. Hope that helps. Well, its definitely illegal to fire someone for being out for a medical reason. I have plenty of documentation from my surgeon. Fuck I have a 4 inch scar on my knee, what else do they need?

I'd only talk to a lawyer if it was a free consultation and if they'd only charge me if I won.

Its cool, this isn't gonna put a damper on my holiday. I wanted to move back to NC anyway, and now my company letting me go made it a lot easier. Not easier financially, but all in all its okay. Just right after returning from medical leave is pretty fucked up.

I am a little worried about my physical therapy though. If I have to get new insurance, aren't they likely not to cover a pre-existing condition?

^^ yeah. Absence makes the heart grow fonder, but not in the job world. They probably figured if they could survive without you for three weeks, they could do so in the long run, and save money. Also, don't put it past the other people in your department to angle for promotion or whisper in the boss' ear while you were gone.

I would definitely look into that insurance thing very carefully.
