that you can be liable for all your own cars damage if you cant prove that you waited after the light turned green an confirmed that no one was coming to run the red light? Allstate just told me they aren't going to pay even though i proved the light was green when i went through because I didn't check for speeders coming the other way. And their insured even admitted to me and them that it was his fault. So basically I'm telling you to be aware, if someone runs a light, sideswipes you or anything else like that, and they aren't drunk or something, you're probably screwed.

ha, if you get hit in an intersection, you probably didn't wait. I don't see how you could possibly prove it.

if you wait and "confirm that no one is coming", I'd hazard to guess that there's a 99% chance that you won't get in an accident. Unless the person is going well over the speed limit and you're going slow through the intersection or a stopped car just decided to blow through with you in it.

Well, his insurance company will be paying if the cop issued citation saying 100% his fault. If they're trying to bullshit you, retain council and sue both the guy who hit you and his insurance company.

What's to say the guy just straight up ran the light after it had been red like 30 seconds?

excerpt from http://www.carinsurance.com/kb/content34677.aspx

Quote :
"
"North Carolina applies contributory negligence to auto accidents. This means that if you are even slightly at fault in a collision you are not entitled to any recovery against the other driver.

Any disagreement you have with the other party's insurer regarding their determination of fault would ultimately have to be resolved in a court of law if you cannot come to an agreement with them on your own. So if they somehow find you 1% at fault and you do not feel you were at fault in any way (and this is just a way to get out of paying your claim) you would likely need to take your claim to court."

not excusing allstate

but get into the habit of always checking everywhere before entering an intersection...it's something i started doing when i started riding motorcycles and driving small sports cars. it's saved my ass a few times.

yep, i sure did know that

read the law, it states pretty much the same thing

a green light means you have the "right to go", not "go"

lol I was going down the peace street exit off of capital on my cell phone and checked way down the road to see if anything was coming and of course nothing was so I didn't slow to a stop and low in behold a jackass sociology professor and his wife were sitting there stopped and I smoked them going about 35 from behind. The cop got there and didn't hold me at fault because they were stopped at a yield sign with no traffic.

After going through law school...I've always reminded myself to make it always seem like I had 0% fault in any occurrence that involves talking to cops or filing a report. If something comes up later...just be like..."oh yeah, I forgot about that" or "I guess it could have happened that way." Insurance companies and cops will pull 180s in a heartbeat if you let one little thing slip that could turn the fault on you.

allstate is fucking shady anyways, "you're in good hands, my ass"

when i got my license at age 16, i was paying 120 a month or so on my car. it was in my dad's name. anyways, at 18 i was going north on glenwood across peace and someone coming from the other way made a left into my path

i had a full green

but it turned out not even being about fault. i called my agent, and he said "insurance follows the owner of the car, have your dad call his insurance"

no shit, i was like WHAT THE FUCK MAN ive been paying 120 a month for like a year and a half for ABSOLUTELY NOTHING.

i still dont get that, NC required me to have that insurance, but it wasnt worth shit. that was my first real taste of "god damn this is a corrupt motherfucking government"

^i thought everyone knew to just add themselves to their parent's policy and pay their parents who in turn pay the insurance company. they should be clearer about that stuff.

[Edited on August 6, 2008 at 7:55 PM. Reason : when the parent is the actual owner of the car, anyways]

All insurances companies suck. When my foot got messed up in an accident the other guys insurance was nice as could be...till they started to find out my injury was going to be expensive.

I've been in two accidents - neither were my fault - and I basically made out like a bandit. Car fixed, compensation, etc.

hell, my poor truck has been in two accidents sitting perfectly still without anyone in it. $3000 hit/run while parked at state and then my mom backed into it with her accord. Exhausts left 2 nice holes in her rear bumper.
