well this came up because my underage friend had a few beers when we were out and he drove home and went through the check point. they checked his license and talked to him a bit and let him go on his way

Hooray for the continuous erosion of the Constitution! It's okay though, I'm sure they'll protect a bunch of people from drivers with failed inspections and unbuckled seatbelts.

i do this too. best method to not get a DUI. and I never drink and drive. when I'm out drinking its normally a cab or a friend is driving, but above all. I PREFER DRINKING @ HOME ALONE. ESPECIALLY IN THE MORNING.

^^It's been tested before. The only states where you'd tend to be safe from a DUI charge are states like CA that have a seperate statute dealing with intoxication and operation of a bicycle. In states that don't have seperate statutes, the courts tend to go with the reasoning that they extend the same rights and restrictions to people in human powered vehicles as motorized ones; that tends to mean they include DUI laws and stuff like that as covering bikes.

I wonder what's the reasoning behind that? DUI on a human powered device just seems like a bad idea anyhow, but the only one getting hurt is the one whose powering it...

Anybody driving drunk should be caught IMO, they make life for me and everyone else that much more dangerous.


On that note, I don't believe checkpoints are particularly constitutional and I hate them.


So I am very torn on whether or not I like these threads. On the one hand, they help law abiding citizens like myself avoid dealing with the bullshit. On the other, they help drunken cocksuckers avoid getting caught.

Well, the reasoning is that if there was a party and someone was about to leave they could check. Hopefully the person wasn't drunk to begin with, but this would be more reason to not drive yet. If the person was underage it could persuade them to not drive at all, even if they were no where near to being intoxicated. Also, if you know your friends are out and you see this thread, you can call them at the bar and warn them.

Not all drunk people are in bars, in case you haven't noticed. So, yeah I'd be willing to bet that there are a lot of drunk people on TWW, who may be headed out to get something or meet someone and would find out about the checkpoint.

It's not that unusual to punish victimless crimes a bit excessively (before anyone flames me, I'm talking about drunk bicycle riding not driving.) The reasoning behind seperate statutes making it illegal but NOT the same as a DUI is that a drunk bicyclist could cause accidents and be a hazard to people driving on the road. The reasoning behind DUI's for drunk bicycling is most semantics and gaps in the law.

DUIs on bicycles are STUPID.

I have pissed off a cop by walking my bicycle home from the bar. All the way. He thought he was gonna be meeting his quota and instead wasted his time.
