This is horrible. But this is also why you keep your dogs on a leash.Three or four times now, I've been walking my dog (a 65-lb black lab mix) on her leash and had this little unleashed pitbull puppy come running up. The first time, my dog liked it just fine. But lately, as the puppy comes over and tries to bite at her ears and face, my dog starts to growl and get angry.Next time it happens, I'm going to have to talk to the owner and just be like, "Listen, I'm not trying to be rude, but I'll be goddamned if I'm held responsible if your dog gets hurt when my dog defends herself because your dog is not on a leash. HE thinks he's playing. MY dog does not think it's fun."

Honestly, if it happened off her property, it's her fault. I have trouble believing he turned the dog over and used his thumb and forefinger to crush it's trachea. That just sounds weird man. Plus, you don't have to let an animal attack you, period. It doesn't matter how big it is. Note that a cat, which is pretty much the size of a chihuahua, can easily inflict serious wounds. A small dog can do the same, which could have easily caused a wound and possible subsequent infection in the victim or his dog. The fact is that he was being responsible and she wasn't, so I don't feel bad for her. He probably held it down until she got there, just like he said. That's not excessive, it's making sure you and your dog (Who are both being responsible) don't get hurt. It's also protecting her little yap yap from running out into the god damned road and getting hit by a car. Honestly it just doesn't sound like he did anything on purpose. If he did, I still don't see the problem with it. Shit man, I'd shoot a dog with no hesitation if it posed a major threat to me. Granted you wouldn't have to shoot the yapper to make it stop, but I definitely wouldn't hesitate to hold it down or fucking punt it back into her yard. It's insane that he's been charged with a crime due to her incompetence as a pet owner. Fuck that shit.I also believe his story a lot more than hers. It makes sense that she would just say "Oh he got out, he's so spoiled" and then walk away. It makes far less sense for him to grab the dog from her, flip it over and use his thumb and forefinger to purposely crush its trachea while saying "this is what my dog would do if it wanted to kill your dog." This is why some people shouldn't own dogs.It sucks that this dog died, but the owner should have kept the thing under control.And she should have trained it so that when it gets away from her it does not act aggressive towards random people/dogs that it might encounter.She owns the responsibility for letting this happen and I hope she is smarter if she gets another one.Maybe the dog was just fragile, but my bet is that the guy did manhandle it somewhat. How else are you going to deal with a snapping dog though?

Isn't there a leash law in Raleigh? So.. the fucking Chihuahua should have been on a leash, if it wasn't and went out to be aggressive, I could care less what happens. There used to be this little nippy dog near my parent's house, every time I went running it would nip on my heels for half a block and the owner would just let it roam outside. Finally I just kicked it hard one day. I didn't kill it of course, but if ti had been old I might have, like in this case. I like animals, but if some dog comes up to me, in the street, and is growling, barking, acting aggressive and the owner isn't there, then people have the right to restrain the animal.

I'm on the side of Upchurch. Sounds like a BS charge. A nasty unleashed 5 lb dog is a problem. Sounds like he might have hurt it, but it was unintentional. If he wanted to hurt it he could just kick it.I agree its the owners fault. Sounds like she babied the hell out of this dog so there's no doubt in my mind all that contributed to a spoiled bad behaving dog.

we have some little cats that run around hereand on a personal not, having worked at a vet clinic, i've seen some pretty mean catsi had one bite my thumb into the bone on each side (through the thumb nail too)... that was probably the worst i had there from any animals (and we had some 200lb dogs that came in)
