Does a speed limit zone start when you see a speed limit sign or once you've passed it?
I got a ticket for going 52 in a 35. I rounded a curve that was 35 mph, but as soon as the curve is over, there is a speed limit sign less than 50 feet. from the opposite direction (where the cop was coming from), there is less than 100 feet of road that is in the 35 mph zone. It is my belief that when he tagged me, I had already passed the 45 mph sign or I was within 50 feet of it. I feel as though this is overly predatory. I was going 7mph over the speed limit, but according to him, I was going 17 mph over, which is a much bigger deal. he obviously wouldn't have pulled me for going 52 mph in a 45 mph.

I know that I can get it reduced to 9 over and get no points. I have a perfect record.
After speaking with an attorney, I have decided that I will:
1) Go to my court date and ask for it to be extended until the following month when the cop will be in court. Apparently, they don't show up to the first date and they don't have to dismiss it at that time, if he misses the 2nd appointment or any other thereafter, I could get lucky.
2) Arrive at second court date, ask officer to dismiss my charges and present my evidence. If he says no, ask for a reduction or get it continued and hire a lawyer. This attorney said that they have to write the tickets, but don't care as much once you get to court if you have a strong arguement. I plan on taking pictures of the curve and plan on showing that there was a 0.01% chance that he could have actually tagged me in said speed zone.
What sucks is, I am not refutign that I was going 52 mph. If they say, ok you are charged with 7 mph over in a 45 mph, I still have a ticket on my record (no points) and pay the fine. In reality, if I was going 52 mph in a 45 mph zone, this fucktard shouldn't have even blinked an eye at me. What a shit head. 10/23/2008 5:04:46 PM |

to me, that's the same as getting it reduced to 9 over without having to extend and fight it....both carry no points and are essentially equal.
^Getting it reduced to 7 mph is different. I don't think he would ever stop ANYBODY for going 52 in a 45. 7 over is practically the flow of traffic.
