He's been giving me the runaround, and finally I figured out today he's got no insurance.

This happened to me a few months ago, the problem is that even if you take him to court successfully, he might not have the money and even if he does he won't necessarily pay. Sure it will hurt his credit but that wont get you your money, which sucks.

I would get him for the cost of a repair, and the cost of a rental car. Get quotes for both.

It might be a long process, but I was under the assumption that if you win, he still doesn't necessarily have to pay. But you will be in a position to hold liens against him at that point, which includes taking amounts out of his pay check

The guy driving wasn't the owner, the truck belongs to his company. That company is out of business. The single proprietor owner of the defunct company is in bankruptcy.

I'm willing to bet there's hidden money somewhere, even if they're bankrupt. You might have to hire a lawyer to find it though :-/

I think it involves signing on as a creditor, and receiving a settlement. I might just be talking out of my ass though.

But even if you do that or something like it and it works, what are the chances that the lawyer would be covered by it, the way our legal system is set up its not even worth suing someone unless its for over 100k
