In the state of NC, no. Rape is defined by penis and vagina -- aka if you're a guy and another guy rapes you, in the state of NC that doesn't legally count as rape, only sexual assault. Also, the victim in question could consent in the beginning but at any point in time if they say no and the person continues the sexual act and doesn't stop, it's considered rape (or sexual assault depending on the sexes and sexual act)...

so way back when i went to college that day, i was dating a girl. (i too, have dated a girl)
