Roommate #1 left $50 cash on the dining room table Monday night to pay for his portion of the cell bill (my account). Roommate #2 is always tight with money. I called #1 to have him grab the money and slide it under my door yesterday AM. Well, its no longer on the table and #1 confronted #2 who of course denied taking it. I know I should have picked it up when he first laid it down...my bad. But damn...its my own house..I figured it would be safe. Roommate #2 stayed in her room all night long and avoided both of us (not normal for her). Roommate #1 is demanding she be kicked out.

Just charge Roommate #2 an extra $50 if you're sure she took it and subtract $50 from Roommate #1. If she balks and doesn't pay (and you know she took the money) then kick her out.

I saw it on the table..so he did put it there. He would not lie and take it back. There is something in #2 past that makes me think she may have taken it.

#1 has crappy credit and he needed a phone so I added a line and we split the plan...(he always pays so its not an issue). I just think its bold of her to take it...knowing full well the other 2 people knew it was there.

i hope you realize that you cant just kick someone out thats living there. you will have to go through eviction whether they are on a lease or not.


Evictions in North Carolina

As in all states, North Carolina does not permit landlords to use "self-help" eviction. That is, a landlord cannot change the locks or otherwise impede the tenant's ability to enter the premises (except in order to maintain or repair the premises), even if the tenant fails to pay the rent.

In order to evict the tenant, the landlord must obtain a court order through a process called "summary ejectment". (N.C. Gen. Stat. §§ 42-26 to 36.2)

The landlord cannot evict a tenant in retaliation for certain protected actions. These protected actions include:
(1) Complaints made to the landlord, his employee, or his agent about conditions or defects in the premises that the landlord is obligated to repair; (2) complaints to a government agency about a landlord's alleged violation of any health or safety laws;
(3) attempts to exercise rights described in the lease in state or federal law; and
(4) attempts to become involved with any tenants' rights groups. If the tenant has undertaken any of these actions in good faith and in the six months before the eviction proceeding, the tenant should bring this to the court's attention. (N.C. Gen. Stat. §§ 42-36.1 to 36.3)

But you could always threaten to file a police report against her if the money doesn't show back up. There isn't much the cops can actually do since there is no evidence, but just the threat of it might make her give the money back.

it doesn't matter if its $1 or $50. In this situation stealing is stealing and she should be kicked out. You can't live with someone you can't trust. Especially if she took it and is denying it. You shouldn't have to feel like everything inside your home has to be under lock and key because of your roommate.

This isn't a simple she ate my bag of potato chips and I know its her because she's gotten fat type of thing.

sounds like you need to be questioning the roommate who supposedly left you $50. apparently he's fucked up his credit so bad in the past that he's not even eligible for a cell phone, so I wouldn't put too much faith in him being that credible either. he could have easily taken the money back after he left it on the table for you.

the fact that its only 50 dollars almost makes it worse. whomever is at fault is willing to be that way over just 50. i mean i've done some shitty and petty stuff when i was in college, things which i regret, but i think you should handle it by telling her you think she took it since you saw it and that if it doesn't turn up then you'll have to consider her leaving.

tell her you're going to look around the house for it later that day and then leave for a while. this way she has the chance to 'return' it without confrontation. she'll also learn her lesson.

You fucked up by leaving money on the table. Seriously, you shouldn't even do that when you live alone - it could easily get stuck on something, or swept under some papers/furniture, etc.

If you're certain she took it, then you gotta decide what strike this is? If you consider her a friend, she should get at least 3 strikes. Roommates who weren't friends before they moved in get 2 strikes.

Well..she was in some trouble before and is on probation. We did not find this out until 5 months AFTER she moved in. And the trouble was for embezelment. I try to give people the benefit of the doubt..we all make mistakes and I wanted to give her a fair shot. But due to the prior charge I have no doubt she swiped the $50

Without proof, it's hard to justify kicking her out. Then again, you might want to anyway, just in case. I had a roomate that brought over a shady date that stole a check out of my checkbook once. My roomate didn't even apologize for the situation, he just said "I don't screen these women or anything" and threw his hands in the air. Instead of making it a big deal, I just waited for the lease to expire, and peaced out. Being able to trust your roomate, and their judgement, makes or breaks the situation.

Yes, it is his fault. I don't drive my car down to south philly, leave the keys in it and expect it to be there when I get back. Yes she shouldn't have taken the money, but he shouldn't be stupid and leave it out to be taken. "Idiot."

First of all, why is "Idiot" in quotation marks up there?

Second, you analogy is horrible. leaving something inside your place of residence and expecting it to be safe is nowhere close to leaving your car in a bad neighborhood with the keys still in it (and even in that case, it is only a "they were asking for it" argument, the thief still makes the choice to take it). if this thread had said "i came back and my tv was gone," would you be saying "well, you shouldnt have left it laying around!"

1. one time some money of mine went missing and i suspected my roommate. i had the money right in the front of my desk drawer and when i went to go deposit it, it wasn't there. turns out something in the desk caught it up and it was all the way in the back behind the drawer, like jammed in there. clearly no one's fault just a fluke

im not saying the $50 randomly got stuck somewhere from the table, but be sure to search hard before creating this potential drama.

2. i cant believe no one has mentioned this--- has the roommate had anyone over? or has the other roommate had anyone over since the money was on the table? have YOU had anyone over? your roommate who paid might be trustworthy but a random friend passing through the dining area might not be.

3. hold a roommate meeting. don't explicitly blame anyone. explain the situation, set an empty envelope on the table and say that whoever has something to do with this better put the money back within 24 hours. this allows her to save some face if she really did it. honestly, if i was the roommate in question and actually took the $50, i prob wouldn't have expected all this drama to result. i'd take the chance to put the money back, no questions asked and anonymously

in the future, have your roommate who splits your cell plan to pay you directly, or slide the money under your door in an envelope, problem solved. or write you a check.
