(CNN) -- A prosecutor is dropping a charge against prominent Harvard University professor Henry Louis Gates Jr. after Cambridge, Massachusetts, and the city's police department recommended that the matter not be pursued.

In a joint statement, Cambridge and the police department said they made the recommendation to the Middlesex County district attorney and the district attorney's office "has agreed to enter a nolle prosequi in this matter," meaning that it will not be pursued.

Gates was arrested last week on a charge of disorderly conduct after a confrontation with an officer at his home, according to a Cambridge police report.

Charles Ogletree, a professor at Harvard Law School who is Gates' lawyer in this case, told CNN on Tuesday that Gates -- the director of Harvard's W. E. B. Du Bois Institute for African and African American Research -- had returned from China on Thursday to his Cambridge home and discovered his front door jammed.

He opened his back door with his key and tried unsuccessfully from inside his home to open the front door. Eventually, Gates and his driver forced the door open from the outside, Ogletree said.

The professor was inside for several minutes when a police officer, Sgt. James Crowley, appeared at his steps and asked him to step outside, the lawyer said.

According to his lawyer, Gates told the officer he lived there and showed him his Massachusetts driver's license and Harvard University identification card. The officer followed him into his house and said he had received a report of a possible break-in, the lawyer said. Gates grew frustrated that the officer was continuing to question him in his home and asked for the officer's name and badge number, Ogletree said.

The police report offers a different account of the incident.

Gates refused to step outside to speak with the officer, the police report said, and when Crowley told Gates that he was investigating a possible break-in, Gates opened the front door and exclaimed, "Why, because I'm a black man in America?" the report said.

"While I was led to believe that Gates was lawfully in the residence, I was quite surprised and confused with the behavior he exhibited toward me," he said, according to the report.

The report said Gates initially refused to show the officer identification, but eventually produced a Harvard identification card, prompting Crowley to radio for Harvard University Police.

Gates followed the officer outside and continued to accuse him of racial bias, the report said. After Crowley warned the professor twice that he was becoming disorderly, the officer wrote he arrested Gates for "loud and tumultuous behavior in a public space."

Ogletree said the professor was "very frustrated" but never touched or pointed at the officer.

He was released from police custody Thursday evening after spending four hours at the police station, Ogletree said.

honestly, maybe this is due to a poorly written article or something, but Im not seeing anything wrong with the officer's conduct in this scenario.

The dude said he lived there. The dude showed his license and Harvard ID (place of residence may not be up to date; Harvard ID isnt going to help shit and wasn't necessary). Officer steps in (whether he asked or not no one said) and states why he is there in the first place. Then the dude somehow takes offense and demands badge numbers and things.

either this is being blown out of proportion or this article is missing a lot of information. Police do this all the time, its all about having good neighbors that are lookin out for the neighborhood whether they actually know who is living there or not. Just a simple mistake.

i know if my neighbors saw some black person forcing the lock to my door that I would like them to call the police, even if it was actually me. It shouldnt depend on whether they know your face or not

So a neighbor saw two people trying to beat in the front door and she calls the cops. The cops show up to check it out and then get into some racial debate with this man and got arrested for not cooporating with the police.

I can understand the mans frustration, but you can understand the officer asking questions after being called about a breakin. Im not sure how he got to "im a black man in america" arguement. Id like to hear the audio of this.

I dont doubt for a minute that the radical African American Studies professor was belligerent, hostile and displayed an attitude to the cop merely investigating the break in. I bet he did not stop for a minute to think "maybe the cops are here because someone saw me forcing my door open and thought it was a break in" I dont doubt for a minute he became hostile and assumed racism when the cop merely was asking for ID to make sure he actually lived there. I also think it never occurred to him that "what if it was not me but an actual burglar, would i want the cop to verify he lived there"

now, depending on how much of an asshole he was, how belligerent he was and how much he delayed the cops investigation, would determine if he was arrested or cited.

even on NPR they said he acted beligerantly towards the officer when the officer realized (after confirmation of who he was by hq etc) his mistake and was leaving, that's what got him arrested.

totally true. there is an incredible amount of unique and valuable culture available in even present day africa. ancient northeastern (sub egyptian) africa is where it's at though

This was my thought when I read the report yesterday.
It said that he initially refused to come out and speak with the officer or produce ID. Somehow made the leap straight to racism and only after a short arguement about why the officer was there did he go get his ID. Then as the situation should have been resolved.....he followed the officer outside still complaining as he was leaving. Nothing about police responding to reports of cime at your residence should cause you to become angry.
