The law right now is that during the ex-parte period of a Domestic Violence Protective Order, the abuser isn't allowed to go back to the place of residence that the victim has, regardless of whether or not they live there.

The new law will state that they CAN go back. So, basically, you're going to be having an abuser going back to the victim's place of protection.. and when they show up, the victim can't have them arrested like the old law stated.

I am so worried as to how many deaths it can lead to... Can you imagine what's going to happen when some crazy abusers (male and female) go back to where their victim is at and be like "Oh, so you tried to lock me up? Well now I'm really going to let you have it."

(And trust me, there are some super crazies out there that would do that same thing..)

First, if some dude is going to come kill you he isn't going to care that you got a restraining order.
Second, just because someone smacked you, does not give you the right to effectively kick them out of their own home. If you don't want to be around him it is your duty to leave the situation. $200,000 house > Black Eye. I hate to say it, but it's true.

Take some personal responsibility for your own safety for a change. The gubment isn't your nanny.

Actually, I'm not kidding, and you don't know what you're talking about.

To even get the ex parte you have to show you're in danger -- they don't pass them out like candy. Furthermore, it doesn't have to be a house, it can be an apartment. I would also like to mention that the abusers are given plenty of resources to help them find temporary housing.

Also, this isn't just where it's like a woman (or man) got a black eye and wants to kick out their boyfriend/girlfriend/spouse... From what I've seen, the people who get it are the types that have been told "if you do anything about it I'll kill you" and then they're shown the weapon.

So for real.. Your "take some personal responsibility for yoru own safety for a change" statement is total bullshit in this case.

edit: I also want to add that when you first go to get the ex parte (which takes place before the DVPO), the alleged abuser is allowed to come and state their case... So if you have someone going against everything you say it's going to make it even harder to receive one.

please tell me you're not this stupid. if someone wants to kill/injure you, they aren't going to stop because of some law that says they can't come home anymore. It's the same thing with guns - law abiding citizens aren't allowed to carry in certain places.... but guess who does any way? that's right, the guy going to shoot up the place. a worthless law isn't going to protect people from criminals with guns or that are hell bent on destruction. if you want to be safe, purchase a firearm and if the asshole attacks you, shoot.
