Fayetteville's city council responded to complaints that police aggressively pushed "consent"("Let us search or there's going to be trouble!") searches disproportionately on black citizens by banning the practice.

The cops called in their union mobsters and used their money to overrule local democracy(local government being the only thing close to actual representative democracy left in this country).

at least is going to court and the dept will be forced to defend their practices....might actually be a good thing.

people need to learn to just say no to these searches.

and this is bringing out some gold golo comments:

Jesus Christ.

If you get pulled over, just give them your license, registration, and proof of insurance if requested. Don't answer any other questions, refuse the request of a search, take your ticket and be on your way.

Fuck all police.

If black drivers didn't also account for 3/4 of traffic stops it would be disproportionate. That, in and of itself isn't an issue, but if it was a substantial variance... say 50 of traffic stops were of black drivers then you could see why it might be viewed as possibly being racial profiling.

i swear even 90% of the cops there are black too

although the fayetteville PD was not allowed to ask to search your vehicle, they could radio the sheriff or highway patrol to do it if they wanted to

you mean they could radio another agency to intimidate you into giving up your rights. they're all about the law, until you use it to your advantage...then it's just 'red tape'

Whats the real issue here? The city council imposed a temporary ban on consent searches - they have/had zero authority to do so because it goes against state rulings.

Consent searches are protected under state law (G.S. 15A-221); municipalities must be consistent with NC and US lawn (G.S.160A-174).

Staley v. City of Winston-Salem ruled that a city cannot enact any law, ordinance, by-law or other act that prohibits or overrides State statutes.

Wilson v. Mooresville ruled that towns have no authority to restrict or enlarge the power of their police.

Also, the Police departments are a managed by a Chief who is under a city manager; a city manager in North Carolina does not have to answer to the city council.

When I first heard about this case, I thought (and still think) this is insane. A city in north carolina can not direct the city's own police force to be more restricted and reserved in their activities than the state allows. How is this at all logical? I can certainly see reason for not allowing cities to grant new powers to their police forces, but to restrict or take away their powers? By what logic does that make sense?
