So let me get this straight.

If I get rear-ended from an Uninsured Motorist, even if I have uninsured motorist insurance, I have to pay $500 deductible out of my own pocket to get it fixed, even though I had nothing to do with it.

This sucks.

Repairs were estimated at $411 and so the insurance company won't pay anything. What the HELL am I paying them for?

(I guess it's the same with Act of God (Hail, etc.) and rocks hitting windshields, which I had to pay $100 to get fixed as well)

you could take the worthless shithead to small claims court, but it won't be worth your time and you can't get blood from a turnip.

If your car had been totaled, you'd be getting a new one for $500.

I bet they'll raise your premiums since you had a wreck now, won't they?

Insurance is a ponzi scheme.

If you could save your money and cover your own repairs, why would you need insurance?
If you don't put in as much as you pull out, and it statistically is shown that 90%+ of drivers will get into an accident in their lifetime, how could insurance cover every claim? That means every person is either over paying or underpaying. (Most likely overpaying)

BUT....you'll see a lot more problems coming up with Obamacare because just ONE hospital bill usually costs 10 to 20 years of an employees wages at minimum wage's work. There is no way Obamacare will be able to sustain this payout/pay-in gap.

At the same time, if you are paying money to insurance to cover your repairs, it's mandatory that people are overpaying because customers have to pay for all the land insurance companies sit on, advertisement, employee wages from top down, taxes, fees, office supplies, and even PROFIT...

Insurance is no doubt costing Americans more money than if Americans just took care of the problems themselves.

People would drive a lot less reckless if they knew that nothing was backing them up and they had to cover repairs themselves.

America is the land of the corrupt.

To the OP: You could have gotten a lower deductible policy....

You can sue him for the diff in small claims court for a $65 filing fee, I would do it, even if he has no money now the judgement is good for ten years.

Usually if you get in a wreck driving with no insurance the police charge the driver criminally and its in the drivers best interest to get it resolved prior to going to court.

Yea.... but.... it should be $0 deductible on principle alone when the driver's not responsible and couldn't prevent it.

Our insurance company said we didn't need a police report whooooops.

I guess I could fill in a police report online, but won't do any good, as I presume an officer would have to assign the ticket.

Yes, in Colorado a Property Damage Insurance of $15k is required.... so it is illegal.

Have you called the guy up and said "hey man, it's going to cost me ~$400 to repair my car. You can either pay that, or I'm taking this to small claims" ?

Most people would rather pay than go through court and get fined + court costs + penalty for not carrying insurance.

call the police before even getting out of your car and talking to the other person.

I got hit by an uninsured shithead once. Totaled both cars.

Didn't know he was uninsured until my insurance company tried to contact his listed with the DMV. The other insurance company said he hadn't been a customer for like a year and that the DMV was just awful at updating their records. The guy also had a suspended license and a bunch of other shit.

I think I had to pay a deductible of 100 or 150, which I eventually was refunded, after the guy settled with the insurance company (they were going to take him to court)

I saw this on "the first 48 one time" the guy met up with him in a parking lot of a body shop to give him the money, and shot him dead instead.

Police report could increase insurance rates, flag my car's VIN# as had been in an accident, and waste my time, for what equated to a 5mph hit in the rear bumper that scratched the paint and popped a piece of trim out.

I'd just sue him. And hope he can't pay so they place a lien on any property he has or gets in the future. Nothings better than having him have to ask you for permission to sell property.

Even if your insurance company does pay, it's still not as good as having money set aside to self-insure to the deductible amount. You still have to do the run-around with them, get police reports, make TWW threads about it.

If the insurance company does pay out money, they might still file suits to recover the costs. They could sue the guy who hit you, or they could sue you. Or they could defend the guy who hit you in court so they could place the liability on you and pay out less. These are smart cookies. Their ingenuity will surprise you.

I think I'm going to call his insurance and ask them what they're going to do about it since they sold him insurance in the state of CO w/out the required property damage amount.

It's not a big deal, I have the money set aside for crap like this, it's just having to deal with the hassle and the annoyance that I'm paying $411 for someone else's accident and that by having insurance it didn't actually help me.

Just a car.

I'd take him to small claims and fuck his credit [even more] all the same.

...and insurance isn't a ponzi scheme--you're just paying money to limit your potential risk.

The fun thing is, even though you'll be getting no money out of them, it still counts as you filing a claim. Even if you call your insurance company to ask about your deductible and how it works, that counts as a claim. So now you have a claim against your insurance even though you didn't cost them anything.

Get a judgment.
Mess up his credit.
Then go jack his rims to sell on Craigslist and get your money back.

actually he wasnt killed because of the accident, that was all good. It was because the dude that was hit kept calling the guy in the middle of a drug deal later on, so the boss told the guy to kill him

Damn, I miss being in NC where the police come out for accidents like this.

I've been hit three times in the past two years here in Maryland (rear ended twice when I was sitting at a red light. Hit once when someone turned right on a red light, and thought it would be a good idea to cross 3 lanes of traffic into my car).
Police won't even come out unless someone is hurt. It all got resolved and shit... still, it makes me feel better having at least a police report on record.

^^ you may just not have known. We didn't find out that until we were shopping around for new insurance. Then found out from a friend that used to work insurance claims that's standard practice.

Eh, my dad has been in the insurance industry (from agent all the way up to district manager) for probably 20 years. I've never heard of anything like that.

I have also called up my company (USAA) and talked to them about whether or not it was worth it to file a claim.

there are generally state regulations on thresholds a company is allowed to hike rates for. in other words, for a minor collision (less than a certain $ amount in damage; probably $1500 or something), they can't hike your rates even if you file a claim (if you have no other insurance points). It's like a 9-over ticket...it doesn't carry enough insurance points. I find it hard to believe that a company would be permitted to count a phone call asking for advice as a claim, if you elected to not file a claim.

yeah, seriously.

like i said, you people must deal with the shittiest insurance companies on the planet.

after i got my car totaled by that jerkass uninsured driver, i was driving my parents extra vehicle so i wasn't in dire need of a new car and the insurance waited until they finally settled with the guy before sending me a check for mine (that took about 4 months). i ended up getting probably $1000 more than my car was worth.

i got no beef with insurance companies.

Bicyclists and pedestrians should be required to carry $1,000,000 in liability insurance in case they bump in to something.
