I just don't see how you can justify the 2nd degree murder charge on things like this. Unless they can prove that you got into the car for the sole purpose of finding another car and going kamikaze with the intent to kill the passenger.

That's a bit of a harder call. Generally, it would be nice to say that no one should operate any vehicle on any drugs, but some of us are on medications all the time anyway, and I think we already accepted caffeine and other uppers as a part of the big rig driving culture to extend the duration they can drive.

Obviously the only answer to this problem is robot cars.

Yes, its a narcotic analgesic and a known impairing substance.

There are a lot of medications people take daily that can impair you; however must people build up a tolerance. Legally prescribed medication that is determined to be the impairing substance is a mitigation factor for sentencing.

^^Yeah, that's what I didn't wanna get into.

People can kinda "get high" on methadone...and the half-life is loooong so it's something that you can accidentally take too much of over time and combine with other stuff without even thinking about it. But I could see a truck driver with chronic pain using methadone in a responsible way (even if he was buying it without a prescription). Or being on his own little illegal maintenance program to help with withdrawal.

That said, he's most likely a run-of-the-mill addict, and I wouldn't be surprised if he had additional drugs in his system besides the methadone/marijuana they found on him. Plus, truck drivers using anything other than uppers is pretty troubling to me...but, I guess they may need to take something to come down and sleep after being up to drive, and the depressants would show up in their systems even if they weren't actually under their influence at the time.

But I'm not sure how much that distinction matters when you kill multiple people on the road.

I don't have a lot of personal experience. I know one person who claimed to prefer methadone to other opiates, but I don't think she could afford it very long before having to switch. Plus, she took a lot of anti-anxiety medications daily anyway. So maybe her preferred drug was really a mix of methadone/benzos.

And the only person I know who has ever been on maintenance meds took buprenorphine, not methadone.

I'm just saying that, while it is "serious business," I could see situations where this guy was trying to do something responsible--like, avoid withdrawal/not get high on the haul or treat actual chronic pain.

^I don't think they prescribe it take-home for withdrawal very easily. Typically, you have to take it in the clinic. So the illegal stuff available on the streets is from prescriptions for pain/stolen, just like all the other meds that people abuse so easily.

I think BAC testers in cars is a wonderful idea. Drinking and driving causes more than 10'000 deaths in the US each year. It may seem like an extreme measure, however, something has to be done.

I think reliable BAC testers should be available to the public at a reasonably affordable rate. When I was looking for one several years ago all the reviews I found showed the consumer models to be wildly inaccurate. I'd consider it again if I saw something indicating that the technology was better.

Requiring every person to have one in their car would probably cost billions and only a small portion of the population would be affected by it. No way I'd agree to that.
