I think this is a very very sad case... but I don't believe testimony of a witness bribed to be there.

Looks like he was determined "Guilty" and sentenced to life. http://www.wral.com/news/local/story/10518672/
I think that was likely the right choice for the jury in this case, even without all of the emotions involved. However, maybe I am overly skeptical, but the ATM photo doesn't prove to me that this guy was in the car, or that Eve was in the back seat. Can anyone else make out anything definitive from the photo? 12/20/2011 11:28:50 AM |
Jeepin4x4 #Pack9 35774 Posts user info edit post |
IIRC, Lovette was the one driving the car and there were better ATM photos than the one posted on that link. The hat he wore in the photo was also recovered i believe.
it's pretty cut and dry if you ask me. I'm just happy that justice has been served and neither of these two will ever see their freedom again. 12/20/2011 11:40:10 AM |

Can you find those? I haven't seen them. I really do think they've got the right guy in this case, I was just shocked they were drawing such an assertive conclusion from THAT photo. 12/20/2011 11:52:40 AM |

There's a lot more to it than the photo. IIRC, they found his DNA in the car and he had the murder weapon in his possession. 12/20/2011 12:41:40 PM |

Yeah, I haven't followed this case as closely as I would have liked, but I did see that there was some other evidence linking him to the crime. I was just hoping there was a clearer picture of him in the car. I mean, that would be enough for me, to vote Guilty. Cause even if he didn't pull the trigger, you've got him for kidnapping and larceny, and any death committed during commission of a felony is murder 1.
Found a more clear picture:

Since he wasn't 18 when he allegedly committed the crime he is not eligible for the death penalty.
Also, it typically costs more to put someone to death than it does to just keep them alive in prison for the rest of their life. 12/20/2011 3:33:10 PM |

which is the lamest statistic in the history of mankind. The punishment, itself, is pretty damned cheap. And, it's extremely disingenuous to add in the time of incarceration until execution into the cost of an "execution".12/20/2011 3:55:22 PM |

Most of that cost goes toward mandatory appeals. Are you so willing to donate money to the appeals process?
Don't get me wrong, I support the death penalty, and think in theory it should have a place in society. In reality, or courts systems are so screwed up, that I don't trust a single verdict out there. Perhaps that's just my jaded perspective, but too many people sit on death row, or serving life sentences for crimes they didn't commit, with people calling for their heads on a platter, and witnesses lying to put them there.
[Edited on December 20, 2011 at 3:56 PM. Reason : ^I wasn't adding in the cost of incarceration, but rather the cost of mandatory appeals.]

and even then, it's a bullshit statistic, as the mandatory appeals aren't given to the guys with life in prison, so you have an apples to oranges comparison. which was my point.
but, I'm with you about not really trusting the system at this point. The Brad Cooper case, as much as I hate to say it, really opened my eyes about how fucked up the system is 12/20/2011 4:02:04 PM |

I haven't been following this particular case, but this article will really make you think about using the death penalty in today's society (and likely make you very angry).
http://reason.com/archives/2011/06/07/wrongful-convictions
In theory, I'm for the death penalty. But in reality...the state of our current justice system makes me think that the death penalty should only be reserved for absolutely clear-cut cases where there is positively no mistaking what happened and who committed the crime (meaning: clear video of the crime being committed and who was involved, or something along those lines).
Most of these Sherlock Holmes type cases where the prosecution has evidence exhibits A, B, and C, and they kind of point to the defendant (but maybe not), and there's a witness who is wishy-washy, and a blurry photo, yadda yadda...and then we find out that the prosecution or police conveniently left out something important that points to the defendant's innocence...I can't see having someone put to death in that environment. The fact that someone's life is literally hanging in the balance based on this crap evidence and the decision of 12 people who are likely morons is absolutely ridiculous.
There is a special place in hell for overzealous prosecutors who withhold exculpatory evidence.

UNC student "journalist" says its Durham's fault that Eve Carson got murdered.
Durham crime crosses over into Chapel Hill
Quote : | "Durham and Chapel Hill are separated only by a 10-or-so-mile stretch of road.
There are no fences, no check points, and thousands of people flow in and out of the cities’ border each day without a second thought.
Five years ago today, two Durham residents — 17-year-old Laurence Alvin Lovette Jr. and 21-year-old Demario James Atwater — crossed that border looking for someone to rob.
And it was chance that placed Eve Carson, the 2007-08 UNC student body president, in their path. In the early hours of March 5, 2008, Lovette and Atwater kidnapped Carson from her home on Friendly Lane in Chapel Hill, took her to at least one ATM to withdraw money, and finally shot her to death in a quiet neighborhood about a mile from campus." |

The irony is that Chapel Hill is a town that actually does cordon off it's entire perimeter with police checkpoints that exclude non-residents on Halloween every year.
