You can still collect unemployment if you were fired. Unless the company you were fired from wants to contest it and say you were fired for something really grievous. In your case, I'd say go for it. The worst that can happen is you get turned down.

GO for it. EVERY single time we have fought an unemployment case they've sided with the employee--and I'm talking people that were coming in drunk as shit, not coming in (and we had records), etc..we lost. FUCKING TRY.

The state of NC really really REALLY wants you to get your unemployment money. When I filed I had the lady tell me that unless you got fired for drug use or violence against a co-worker that you were practically assured of winning your claim. And even if you did get fired for one of those things that it was about 50/50 that you would get it.

Honestly, I don't see you not getting it.

nah, it's more the instant messages that were the problem. I think my boss could and would have overlooked the TWW usage and any other personal websites I browsed, but she had copies of every IM we sent since January 1st. Most of them were pretty raunchy. And she had sent a few to me talking trash about my boss. None of mine talked shit about my boss because i actually got along with her great.

a 3rd person got fired as well, but hers were for personal e-mails she sent from work. our boss actually logged into this chick's e-mail and printed out all the e-mails she sent while at work.

Yeah, I was pretty stupid. Granted, we never did anything AT work other than the IMs. We never even touched each other during business hours. that sucks I log onto stuff like tww and other sites while I am at work but its just the way I work...I am ADD. But I usually just eat lunch at my desk and work through always get all of my work done and I have other responsibilities at work outside of my main job (working with our intranet site etc.) so I feel like simply using the internet a decent bit would hopefully not be a huge problem (since I am never posting inappropriate stuff) and if it was I would hope they would bring it up to me before firing me.

well, from what you have told us, you were one of her best (most profitable) employees.
so, that's probably going to suck for your old boss to 1) find a replacement that can do what you do, 2) train that replacement and 3) pay you unemployment

oh yeah, I meant to say earlier:
your boss can fight that unemployment thing, but she most likely won't win. It's hard to fire an employee and come out in a good light when you haven't given them 'warnings' about problem behaviors, and also taken steps to mediate the problem before it resulted in a dismissal.

no, it is REALLY going to suck for her firing my coworker. I was only there 5 months so I hadn't built up much of a client base. my coworker had been there for almost 3 years, and she is REALLY close with all of her clients. i can almost guarantee none of them will be doing business with my former company again. so not only does she need to hire and train a brand new sales staff, but she is going to lose a majority of the clients she already has.

yeah, to me it sounds like someone has told her she needs to cut some people so she's fishing for reasons. unfortunately for her it sounds like she got rid of people that were making the company money so it was pretty idiotic to do. surely there was someone that was doing a worse job that would have been a better candidate to fire.
