agreed, but plenty of lawyers do this. they'll answer formal discovery or respond to motions and orders, but when it comes to a simple one on one conversation over the phone or in person they won't give you the time of day.

I think the accusor is going to stop cooperating with investigators before the trial even starts. (for all we know she may have already) That will give Nifong an easy out, when the charges get dismissed he can just claim its because the "victim" wanted to move on with her life and was not comfortable testifying. Then he does not lose face to all of the people in Durham who support the prosecution.

i wonder if the klan still has a local presence to deal with the "accuser" if that is the way this ends up.

not that im racist, but everyone else seems to be. twould be a fitting end, an ironic twist to the black panther support of the "accuser", and the beginning of the end for the south.

Maybe, but what is more odd to me in this case is that the prosecutor refused to see any of the defense's evidence. That is extremely odd - usually each side is scratching and clawing to get at every piece of evidence the other side has. When I have tried cases, I make extensive use of discovery - I want to know every crumb of evidence that the other side has. To be offered evidence by the other side and then refuse to look at it, is extremely weird.

Wolfpack2K: then you're a good attorney and i would enjoy doing business with you. you scratch my back i scratch yours kinda deal.
a few that i've had to work with have been a hassle to try and get info even after we've requested in discovery--and they're the kind that are known for giving the otherside the runaround.

Evans is the defense, not the prosecution. The prosecutor is the DA, Nifong.

Ok now I do understand vigorously representing your position, but laughing in a situation like this is entirely uncalled for. Even if Nifong has no respect for the defendant or the defense attorney, he should at least have nominal respect for the court. If I had been the judge, Nifong would be sitting in jail tonight.

It looks like the accusers parents are hiring a scumbag, Johnny Cochrane type lawyer to lay the groundwork for a civil trial. The guys website is terrible, it has him with Bentleys and talks about his new private jet with gold sinks and stuff. Absolutely the worst of American "justice".

Has anyone thought about maybe getting together a pro-players, or at least pro-due process, group together to go to the next court date and counter these people by holding up supportive signs and "Innocent Until Proven Guilty" chants?

Ordinarily I would rather have a nose on my ass than go to Durham for any reason, but for that, I would drive up there from Georgia.

I watched the big story (or whatever its called) the other night on TV. They have one anchor and 3 people on who argue their points on national tv.

First time i ever seen all three agree on something. Pretty much they all said that Mike Nifong was "a deer in headlights" and the "defense is doing a great job".

They were also talking about the civil suit. They all agreed also that the defense wouldn't do it.

I am wondering how waiting a year or more just for the trial to start can be considered speedy justice. And I wonder how many other people are sitting in jail, falsely accused because they can't afford bail.

Stop all the lie detector test talk. They mean nothing. These tests measure things like breathing rate, heart rate, prespiration, etc while asking questions. This means that the tests can be false due to nerviousness, etc.

It also means someone who is informed can beat them be over exaggerating the control question and under exaggerating the question were they force you to lie.

Or if you are chuck norris you can beat it because your a badass and always in control of things like breathing rate, etc.

Exactly, he's like Keanu Reeves character in The Devils Advocate. Being a good lawyer has nothing to do with being a good person or being ethical. Its like the scumbag lawyer Richard Giampa who defends rappers who murder people. He even sued here in NC to keep the public from using the beach in front of million dollar homes.

he'd be more of a scumbag if he got paid millions of dollars for his services and didn't do the best job he possibly could. that's what defense lawyers are required to do.
