What if Eve didn’t believe in the death penalty? Or if her parents came out and said specifically that they don't want these guys to be put to death? Do you think it would, or should, affect sentencing (if they are convicted)? 3/13/2008 10:08:25 AM |

Quote : | " Barry Saunders, Staff Writer Hey, wait a minute, pal. I didn't kill anybody. Honest.
Ever since the black dude showed up on television in the hooded sweat shirt and tilted baseball cap profiling for the ATM camera -- no, even before he showed up on television -- trying to withdraw cash from Eve Carson's account, I've been getting telephone calls and e-mail from people guaranteeing that her killer was black.
Now that two suspects have been charged in her killing, don't expect the quality of Internet discourse to improve.
The people from whom I heard were equally confident that I was -- as was every other black person in the Triangle -- somehow responsible for her death and would ultimately pay the price for it.
One of the more thoughtful, responses I received to Carson's death -- we're grading on a curve here, folks -- referred to the baseball cap insignia: "Your bro Cool Papa Astro has set race relations, at least in the Triangle area, back 100 years."
I knew that was coming.
That's why most black people I know thought -- no, prayed -- that the person responsible wasn't black. A lot of us won't admit, even to ourselves, that we feel that way, but trust me. We do.
The violent death of anyone is tragic and diminishes us all, although the impact is usually most profoundly felt among friends and family members.
Eve Carson's death was a loss that will reverberate throughout society because of the good she won't be able to accomplish. A person that young who had already had such a positive impact on her world, as evidenced by the thousands of students who gathered at the campus vigil in her honor, could over time have had an immeasurable impact on the larger world.
The people suspected in her death are black, but they represent all black people about as much as Timothy McVeigh or those Columbine killers represent all white people -- which is to say not at all.
Evil is not race-specific.
If they represent anything, they represent our failure as a society, but mostly as a black society, to adequately address the problem of young black dudes who've seemingly bought into the predatory gangsta lifestyle romanticized in some rap music and videos.
Don't look at me like that. It's no secret that a disproportionately high percentage of crimes is committed by young black males. That's something we all have an obligation to address because, guess what, they sometimes venture forth from their own blighted neighborhoods into idealized slices of heaven such as Chapel Hill.
You know what would be sad? And ironic? If my letter-writer was right and Carson's death led to a widening of the racial chasm in the Triangle.
By all accounts, she was a person who treated everyone well, from the Tar Heel basketball star to the lowly freshman science nerd. Believe me, 5,000 people don't show up at vigils for peers who led self-involved, cliquish lives.
A black woman interviewed on television as she entered the church for Eve's funeral said Eve and she were best friends from high school. At her funeral, I saw blacks and whites grieving her loss, none as much as one brother whose whole body heaved with each heartbroken sob.
Eve Carson won't get to fulfill the promise her past only hinted at, but her legacy would be tarnished if ultimate blame for her death were attributed to anyone but the misanthrope who actually pulled the trigger. " |

...and I know when I first heard that she had been shot in the head multiple times I assumed that it was by someone she knew, likely a white person. But the hearing was rescheduled because of a scheduling conflict, sources tell WRAL News.
If the hearing had occurred March 3, they said, Atwater could have been sent back to jail that day.

The whole situation is complicated. I mean people who have a felony conviction and have enemies usually can't depend on law enforcement to keep them from being murdered. I can see why they might want a gun.
I don't think that is an excuse though. At some point you have to have a wake up call. If someone is on probation gets charged with another felony its time to say well since that did not work you are going straight to jail. Too many second chances and the criminal justice system becomes impotent, it can't perform its most basic purpose which is to protect society from dangerous and violent people. 3/13/2008 7:47:57 PM |

Quote : | "Raleigh, N.C. — One of the murder suspects in the shooting death of the University of North Carolina at Chapel Hill's student body president was in a Wake County courtroom on a probation violation two days before her shooting death.
But Demario James Atwater's hearing was rescheduled because of a clerical error, Clerk of Superior Court Lorrin Freeman said Thursday.
Atwater showed up in courtroom 2-D at 9 a.m. March 3 with his probation officer. But his court file was sent to a different courtroom, Freeman said.
The judge and all parties involved agreed March 3 to reschedule the hearing for March 31.
Two days later, on March 5, Chapel Hill police found UNC senior Eve Carson's body about a half-mile from the campus. Atwater, 21, is one of two suspects charged with first-degree murder in connection with her death.
At age 18, Atwater was sentenced to three years' probation after being convicted of stealing a rifle, shotgun and a cooler.
A 2007 conviction on a gun charge, to which he pleaded guilty, was in violation of his probation, the state Department of Correction said.
Atwater was arrested Feb. 20 on the probation violation and was released under a $10,000 secured bond. His court date was March 3.
The Department of Correction said had the hearing occurred, Atwater could have been sent back to jail. Or another court date, which would have been similar to a first court appearance, could have been scheduled.
Both Atwater, 21, and Lawrence Alvin Lovette, 17, also charged with first-degree murder in Carson's death, have criminal records.
Atwater's dates to 2004 and includes charges of robbery, drug possession and resisting arrest. In 2006, he was sentenced to 24 months' probation for possession of a firearm as a felon.
Lovette's criminal record includes charges of breaking and entering and larceny, for which he was on probation before his arrest Thursday. He was due in a Durham court this month on charges of first-degree burglary, felony larceny of a motor vehicle and felony larceny after breaking and entering in connection with two crimes from February.
He was also charged Thursday with first-degree murder in the January 18 shooting death of Duke University graduate student Abhijit Mahato; and also charged with several other charges connected to crimes from mid-February.
Atwater and Lovette both went to Jordan High School in Durham and withdrew in 2002 and 2007, respectively, Durham Public Schools Spokesman Michael Yarbrough said Thursday.
Atwater later enrolled at Apex High School, where he once got in a fight with another student over a blue bandana he displayed on campus, Apex Police Sgt. Jacques Gilbert, a school resource officer, said.
"We interviewed Mr. Atwater. He indicated the blue bandana represented a gang that he was affiliated with," Gilbert said.
The gang was based in Durham, where both he and Lovette were arrested this week.
But Durham Police Chief Jose Lopez said Thursday that at this point in each of the cases, he does not want to "give any credit to any gangs."
"I believe they are two young men who were involved in some robberies and homicides, and they have been charged as such."
Atwater, who was arrested Wednesday, is being held in the Orange County Jail without bond. Lovette, arrested Thursday, was being held in the Durham County Jail without bond Thursday.
He could make an appearance before a judge as early as Friday to face charges in connection with Carson's death, Orange County District Attorney Jim Woodall said." |

Quote : | "Durham, N.C. — A cell phone helped link Lawrence Alvin Lovette, the second suspect charged with murder in the death of UNC Student Body President Eve Carson, to the shooting death of a Duke graduate student.
Durham County Assistant District Attorney Tracey Cline said during a brief court appearance that the phone and an iPod stolen from Abhijit Mahato's apartment the night he was killed was found on Lovette when police detained him Thursday morning in the Carson case.
Lovette was charged Thursday with first-degree murder charge in Mahato's Jan. 18 slaying and several other charges connected to crimes from mid-February.
According to the arrest warrant, Lovette allegedly stole a cell phone, wallet and an iPod – with a combined value of about $300 – before Mahato was shot to death inside his apartment at 1600 Anderson St.
"There was information that investigators obtained that the victim's telephone had been used … the night or early morning he was murdered," Cline said.
Investigators learned numbers on the phone traced back to a number associated with Demario James Atwater, Cline said.
Atwater, 21, is not charged in Mahato's death, but Durham Chief Jose Lopez said Thursday police were looking to see if he might have been involved.
District Court Judge Craig B. Brown ordered Lovette to be held on a $3 million bond, appointed him a public defender and set his next court date for March 27.
Afterward, Brown, a graduate of both the University of North Carolina at Chapel Hill and Duke, spoke for about 5 minutes, saying he was going to call on the governor for a special session on anti-gang legislation.
"I respectfully and sincerely ask the governor to call a special session of the Legislature. I'm sending an SOS in Raleigh," he said.
The 17-year-old former Jordan High School student was wanted on a first-degree murder charge in connection with Carson's March 5 shooting death in Chapel Hill. Durham police arrested him early Thursday after nearly two hours of negotiations.
Lovette is expected to appear before an Orange County judge Friday afternoon to face charges in Carson's death. The 22-year-old UNC senior was found shot to death about a half-mile from UNC's campus.
Durham police have said, at this point, they do not believe neither Mahato nor Carson's death was gang-related. And Chapel Hill police have said they are investigating all possibilities.
Lovette's criminal record includes charges of breaking and entering and larceny, for which he was on probation when he was arrested Thursday.
He was due in a Durham courtroom this month on charges of first-degree burglary, felony larceny of a motor vehicle and felony larceny after breaking and entering, all related to two crimes from February.
Atwater, who has a record dating to 2004, had been in Wake County Superior Court on a felony probation violation March 3, but the hearing was rescheduled because of a clerical error.
Correction officials said that, had the hearing occurred, Atwater could have been sent back to jail." |

"Suck at life and failed themselves" is way too simplistic. It's pretty lame to write off social problems as individual character issues.
And I don't think Saunders is accusing you of failing anybody. And he definitely wasn't saddling you with the obligation to address the actions of "some ignorant ass nigs."
