In Texas (where you have to have your weapon concealed if it is in your car) this would not be considered concealed. I had my gun in the map holder on my drivers side door and when I was pulled over I got a lecture because the cop said if he was looking in the passenger window he might be able to see part of the handle sticking out. Depends on the City; for example, NYC would need officers to man times square but also have regular rank and file taking calls for service. In the city I use to work in, it was just another night.

So get this. Saturday night...or really Sunday morning...around 1:30 am...I'm driving home from my friends house. Sober. I am in a 35 mph speed limit zone. So that I don't give a cop a reason to pull me over I set my cruise control. I am driving down the road and see a cop going in the other direction...and just like habit I check my speedometer. I am going around 35 or 36. As soon as I look up from my speedometer and check my rear view mirror there are blue lights behind me...
I pull over the cop says. "Do you know how fast you were going?" Me: "35" Her: "I clocked you at 45" Me: "Do what? I had my cruise control on 35?" Her: "Oh...can I see your license please?"
She then calls it in, doesn't go back to her car or anything...just calls it in right beside me and then sends me on my way.

say she had been drinking that evening, and ended up blowing over .08, would the whole thing get thrown out due to the lousy pretext for the stop in the first place?

Keep in mind in court a police officer has to be able to testify that you were exceeding the speed limit by using his or her judgment, not the gun. The radar is merely a corroborating tool. If you are going almost exactly the limit, an officer is not going to be able to testify in court that they can discern speeding that closely.
I won't go into all the particulars, but if you actually have received a ticket for going only slightly over the limit, you can research the NC case law yourself or your lawyer will be able to do it. 1/20/2013 8:11:19 PM |

That case law - if its the recent decision - attacked the training of the officer; he basically couldn't recall how many feet were in a yard, and basic units of measure so the court ruled there was not way he could estimate speed if he was such a dolt. About the same time, another case came out about estimated speed and the officer(s) were good to go.

What's up with "Drunk and disorderly conduct," then?
I'm thinking of a particular instance in which I was riding in the car, and we got in a yelling match with some women in another car, and I very loudly (i.e. screamingly) called them a bunch of "Stupid fucking cunts." We pulled into McDonald's right after that, and while we were in the parking lot this cop walks up to our car, shines a flashlight in my face and says "Give me one reason I shouldn't take you to jail for drunk and disorderly conduct."
Could he have done this?

I convicted a guy in court a few months ago of basically cussing at a woman loudly outside the entrance to Wal-Mart. He had some sort of argument with his girlfriend, the cops showed up, and when they took him into custody he was still yelling and cussing. People were going in and out of the store, and the only thing I could get him for was disorderly conduct.
