i figure some cop/law enforcement fucked up with some procedural step during the investigation that they knew his lawyers would exploit the hell out of if it got to court so they just dropped it? but who knows

"When they had a chance to go to the site, they discovered animal neglect," Surry County Administrator Tyrone Franklin told WAVY-TV in Portsmouth.

More than 60 dogs were found in three buildings. Some appeared malnourished, scarred and injured, officials said.

Wayne Pacelle, president and CEO of the Humane Society of the United States, issued the following statement: "The Humane Society of the United States has heard troubling reports for some time that Michael Vick has been involved in organized dog fighting, and we fear that this investigation may validate that very disturbing allegation."

"We urge law enforcement to aggressively investigate this matter, and we further believe that anyone who harbors dogs for the purpose of fighting, deserves to be fully prosecuted for their crimes,'' Pacelle said. "Dog fighting is a barbaric activity that causes immense animal suffering and fosters violence in our communities. Our nation should have a zero tolerance policy for any form of staged animal fighting."

The Humane Society said dog fighting is illegal nationwide and a felony in 48 states, including both Virginia and Georgia.

Vick refused comment Thursday through a Falcons spokesman, according to The Atlanta Journal-Constitution.

Joel Segal, the quarterback's agent, and Larry Woodward, a Virginia attorney who has worked with both Vick and his younger brother, Marcus, didn't immediately return telephone messages from The Associated Press seeking comment.

The Surry County Sheriff's Office is handling the investigation of the dogs' treatment. The office said the deputy in charge of the investigation was at the scene and unavailable for comment Thursday.

The animal rights group PETA has asked Falcons owner Arthur Blank to suspend Vick pending the investigation and "to kick him off the team if it is found that dogs on Vick's property were neglected or used for fighting."

In a letter to Blank, People for the Ethical Treatment of Animals said it was the second time it was writing to the owner about one of his players and allegations of cruelty to animals. On Feb. 23, the organization wrote to him about defensive tackle Jonathan Babineaux's felony charges in Georgia stemming from the fatal beating of a dog.

The probe at Vick's property is the latest in a serious of embarrassing incidents for the Atlanta quarterback.

He was named in a sordid lawsuit that accused him of knowingly infecting a woman with a sexually transmitted disease and using the alias "Ron Mexico" while seeking treatment. The case was settled out of court.

Last season, Vick flashed an obscene hand gesture to heckling Atlanta fans as he walked off the field following a dismal loss to New Orleans. He was fined $10,000 by the NFL and donated another $10,000 to charity.

In January, security officers at Miami International Airport seized a water bottle from Vick that they said smelled of marijuana and had a hidden compartment. Authorities later said there were no drugs in the bottle, and Vick explained that he used the secret compartment to carry jewelry.

Just this week, Vick came under more criticism when he failed to show for a lobbying appearance on Capitol Hill in support of increased funding for after-school programs. He missed a connecting flight in Atlanta and didn't turn up for a later flight.

Vick and two other former Virginia Tech stars -- Falcons cornerback DeAngelo Hall and former Buffalo Bills defensive end Bruce Smith -- are scheduled to join Hokies football coach Frank Beamer and NFL commissioner Roger Goodell in a predraft ceremony in New York on Saturday to honor the victims of the recent shooting at the Blacksburg school.

"The facts in Michael Vick’s latest encounter with questionable behavior are still coming to light. No matter how this dog-fighting mess turns out, Vick would appear to require all his considerable broken-field running ability to avoid stepping in you know what.

Atlanta Falcons owner Arthur Blank already has provided notice that his quarterback is “on a short leash.” If his phrasing was intentional, Blank has missed his calling. Clearly, Vick is in the doghouse.

The more pressing question for NFL fans is whether Vick is actually the dog. When a player’s career slides past six seasons without fulfilling hopes, the word “potential” almost becomes pejorative.

Vick is on his third head coach as he enters his seventh season. Bobby Petrino spent his first mini-camp dodging questions about Vick that are beginning to validate comments by NFL Network commentator Jim Mora last season. Mora’s son didn’t appreciate the timing or the sentiment of his dad’s radio conversation about a “coach killer,” but sometimes, father still knows best.

It was painful to listen to Vick talk during the draft about how he is finally going to start taking his profession more seriously, how he is going to work harder to change his image as a great athlete with little clue of what it takes to become a great football player and apparently no obvious desire to put as much time into the art of quarterbacking as say, Peyton Manning, Donovan McNabb and most others do.

As ESPN commentator Ron Jaworski, a former quarterback, said of Vick: “When all is said and done, more is said than done.”

Although facts about Vick’s involvement with killer dogs on his Virginia property remain unclear, here are the facts of his life as a professional quarterback:

He is Drew Brees, Jake Plummer, Kordell Stewart, Mark Brunell, Vinny Testaverde, Daunte Culpepper, Shaun King, and Randall Cunningham — all quarterbacks who like Vick have taken teams to a conference championship game and no further — all within the past nine seasons.

Brees, of course, is the most interesting and flattering comparison. In 2001, the San Diego Chargers traded the rights to draft Vick No. 1 to Atlanta and took running back LaDainian Tomlinson in the first round and Brees in the second. Last year, Brees moved into Vick’s NFC South division, beat Vick twice, led the NFC in passing, and took the New Orleans Saints to their first-ever conference final.

Quarterbacks are first and foremost judged on their ability to help their teams win games. By that criteria, Vick is no better at the moment than any of the above, and Brees is the only one who still has a starting job at the moment, unless King’s Arena League employment counts.

Vick proved one thing last season. He is better than Bobby Douglass, the Chicago Bears’ quarterback of the late 1960s and early 70s who held the season rushing record for a quarterback. Like Vick, Douglass was left-handed. Like Vick, Douglass was an exceptional athlete who often looked like he should be playing another position.

Here’s another fact about Michael Vick: He’s not as good as Rex Grossman, Matt Hasselbeck, McNabb, Jake Delhomme, Rich Gannon, Kerry Collins, Steve McNair, Drew Bledsoe, Neil O’Donnell or his predecessor in Atlanta, Chris Chandler — all quarterbacks who have taken teams to Super Bowls within the last 12 years.

Petrino says he intends to make Vick a 65 percent passer. That would hike his completion percentage 11 points. Last season, Vick completed 52.6 percent of his passes, which put him ahead of Tennessee rookie Vince Young and nobody else. In Vick’s last three seasons, his completion percentage has slid from 56.4 to 55.3 to 52.6, hardly a sign of progress.

As for passer efficiency rating, Vick’s 75.7 last season ranked 20th. It was a tick below his career mark of 75.8, which puts him below average for his career.

As for leading the Falcons to victory, Vick’s record as a starter is 38-28-1. That squeezes him into the upper third of veteran quarterbacks, not bad. But the past three seasons, the Falcons have gone from 11-5 to 8-8 to 7-9.

Vick is a below-average quarterback capable of occasionally outrunning his mistakes or team shortcomings. The only rational basis for his $130 million contract is his ability to sell tickets to fans who like to oooh and aaah. The Georgia Dome looks like a giant circus tent, and Vick is the main attraction.

The difference between the circus thrill show and the NFL is they keep score in only one of them. Petrino and the Falcons can only hope Vick might start to notice the scoreboard as well as the video highlight screen as he starts his seventh season. So far, he’s way behind in a lot of areas including expectations.

If Vick intends to clean up his image by accompanying schoolchildren to petting zoos, he will only be turning his dilemma into a dog and pony show. Instead, he needs to spend the dog days of summer working like a horse. If only he would start putting more time into his quarterbacking, he wouldn’t need to spend his leisure time explaining why he has so much of it he doesn’t know what to do with it."

SURRY, Va. -- As car after car -- and one evidence collection truck belonging to the Virginia State Police -- darted out of the fenced yard surrounding Michael Vick's property, the officers inside gave barely a glance to reporters waiting across the street.

Pulling the gate closed, though, one of the last men to leave Thursday night said investigators had done some digging and that he didn't expect to be back anytime soon.

"I hope I never see this place again,"
the man said, refusing to identify himself.

On a day when a search warrant a Surry County sheriff's deputy drew up expired unexecuted, federal law enforcement officials showed up with one of their own for the NFL star's property, indicating that they are taking over a slow-moving probe into possible dog fighting.

It was a development that left Gerald G. Poindexter, the commonwealth's attorney who would have been charged with prosecuting the case, dumbfounded -- and more than a little insulted.

"What is foreign to me is the federal government getting into a dog-fighting case," Poindexter said in a telephone interview. "I know it's been done, but what's driving this? Is it this boy's celebrity? Would they have done this if it wasn't Michael Vick?"

Poindexter said he was "absolutely floored" when federal officials told him at just about the time the search began that they were moving in. He said he believes he and Sheriff Harold D. Brown handled the investigation properly and wonders how it was elevated to a federal case.

But it sure looked like one at the massive two-story house on Moonlight Road.

More than a dozen vehicles went to the home early in the afternoon and investigators searched inside before turning their attention to the area behind the house. That's where officials found dozens of dogs in late April -- some in kennels, and some tied up with chains -- and evidence that suggested someone at the home was involved in a dog-fighting operation.

With news helicopters circling overhead and confirming that investigators were digging with shovels, they were only seen removing a cardboard box and a large sheet of plywood.

State police assisted the U.S. Department of Agriculture and the U.S. attorney's office in executing the warrant, Virginia State Police Sgt. D.S. Carr said, declining to comment further.

Surry County officials had secured a search warrant May 25 based on an informant's information that as many as 30 dogs were buried on the property. The warrant never was executed because Poindexter had issues with the way it was worded. He said another was in the works.

No more.

"If they've made a judgment that we're not acting prudently and with dispatch based on what we have, they've not acting very wisely," Poindexter said.

Before the events of Thursday, Poindexter said the investigative team was planning to meet soon to go over the evidence it has collected, to assess its reliability and make sure it had all the experts needed to help make its next search most helpful to the investigation.

Now, the case has gotten bigger again, and it's somebody else's.

"There's a larger thing here, and it has nothing to do with any breach of protocol," Poindexter said, still trying to rationalize where the federal government fits in. "There's something awful going on here. I don't know if it's racial. I don't know what it is."

Vick and Poindexter are black.

Messages left at Brown's office were not returned, and a dispatcher said he left for the day at around 4 p.m. An after-hours call to Vick's attorney, Larry Woodward, was not returned.

It was during an April 25 drug raid on the home that authorities seized 66 dogs, including 55 pit bulls, and equipment that told investigators they'd uncovered a dog-fighting operation.

A search warrant affidavit said some of the dogs were tethered with "heavy logging-type chains" attached to car axles that allowed the dogs to get close to each other, but not to have contact, one of myriad findings on the property that suggested a dog-fighting operation.

Other items included a rape stand, used to hold non-receptive dogs in place for mating; an electric treadmill modified to be used by dogs; a "pry bar" used to open the clamped-down mouths of dogs; and a bloodied piece of carpeting the authorities believe was used in dog fights.

Poindexter said that during his own inspection of the property and its several outbuildings, he saw a floor in one building stained with what appeared to be spattered blood.

Vick, a registered dog breeder, has claimed he rarely visits the home and was unaware it could be involved in a criminal enterprise. He also blamed family members for taking advantage of his generosity early on, but has said since his lawyers have advised him to say nothing.

Vick's cousin, Davon Boddie, was living at the home at the time of the raids. "

I liked Poindexter just b/c he would give updates every other day, but why the hell is he trying to make this racial? He was handling the case wrong by stretching out the investigation and talking to the media all the time when he shouldn't have made any comments. Now he is just crying like a little bitch cause he wanted more time in the national spotlight. Per Mortensen, Falcons owner Arthur Blank is out of the country, will be getting back tomorrow, and is shocked cause they were led to believe a couple weeks ago that people would be indicted in the case, but not Vick.

didnt find any indicted reports and on google the latests reports were from july 13th(like 2 or 3 reports that day) all saying vick most likely would not be indicted

I'm guessing 4-8 game suspension, depending on the details that emerge in the case. It would be longer, but this is Vick's first real incident.

I doubt the trial will be resolved this season.

This is his first indictment, he's had plenty of incidents. Hardly a season goes by without him fucking up.
