the argument here is that you can't get a jail sentence for this only a fine. my proof is that a jail sentence was given but because of his age, race whatever you want to call it, it was deferred. Meaning it is possible to receive a jail sentence.

i think if him selling it played a big part in the case the article would have been written completly different.

maybe something along the lines of

"Student sentenced for downloading and distributing pirated material"

the fact that the very last sentence in the article is some quote of some guy saying "oh yeah and he sold some of it!" just shows that it had little to do in the case.
