i think he meant theft in a figurative sense, in that you are taking/using/destroying something that belongs to someone else without their consent and/or by force.

other than drugs, that definition fits the rest of the crimes on your list.

Correct, because drug use is not a real crime. The only difference between marijuana and alcohol is their current legal status.

i think it borderlines cruel/unusual, more unusual than anything

and the fact that they were given a choice between it and jail is not an excuse

a ruling in which two men were allowed to either a) go to jail for a certain num of years or b) get castrated was overturned, rightfully so, but just to show that a choice is not an excuse if one of them is cruel and unusual - not that rape convicts don't deserve it, but you know, constitution, etc...

I'm just suprised they even threatened jail time, I mean shit for $7 dollars? It would have cost a shitload to put someone away for 60 days.


Next thing they should do is to get Walmart from stealing from there employees.

i do not see a problem with this. the rapists/child molesters/ whatever can just go to jail if they think getting castrated is to cruel for them.

honestly i do not see anything wrong with castrating a child molester. maybe he should have thought about the punishment before having sex with 7 yr old sally

maybe they had prior convictions then...

its not cruel and unusual in the physical sense, but it is public humiliation sanctioned by the courts.

Also it is not THAT common, and as such, i would say it is unusual...probably why it made the paper

seems like a good counterpoint to the culture of stealing to be "cool"

what's wrong with a little humiliation? Its not like we are cutting off their hands or something, its a sign.

anyway, criminals should be humiliated, its a healthy part of making people feel guilty for their crimes.

And by the same logic, castration is a great counterpoint to the culture of raping due to "instinct" or "aggression" or [insert reason here].

I think its sketchy because these "punishments" are not done across the board

i agree and i dont remember reading anything that mentioned how many tax dollars this kind of punishment will save.

instead of sending someone to jail for 60 days paying to feed and board them with the other costs put them on the street and humiliate them first...if that doesnt work for a repeat offender then send them to jail

Not really. If public humiliation works then it is a good alternative to sending people to jail.

But not sending people to jail without an alternative is not an option.

I thought last year Wal-Mark changed their guidelines for the prosecution of shoplifters: "the retail value of the merchandise recovered must exceed $25, and the suspected shoplifter must be at or between the ages of 18 and 65.” Correct me if I'm wrong...

I have a friend, now 23, who is trying to expunge a shoplifting charge from her record. When she was 16, her 14 year-old sister shoplifted something worth less than $10 from Walmart & somehow she has a record from her sister's transgression. I think you can only expunge something from your record once in your lifetime, so she is in the middle of that process, unable to get a "real" job in the meantime.

I did not read the thread, but I will throw in my .02. This issue was explored on an episode of Boston Legal, incidentally. For those who care.

Anyhow-- I think this would be a TERRIBLE sentence if the "victim/suspect/convict" (whatever) was FORCED to wear the sign. She did it as a plea bargain of sorts, though, and I think that justifies it. She could have just as easily taken the jail time and avoided the humiliation, but served the sentence like anyone else would for a similar crime.

Maybe she got off easy, but maybe in that process she was embarassed enough to learn a lesson.

Fuck walmart for tolerating this demeaning treatment of a member of the community. Fuck the court for leveraging a citizen to demean herself to avoid justice. FUCK THIS goddamnit. Let me get a basic rundown of Walmart security; there's bubba and shaniq eyeing the customers to see if they look guilty right? What else do they have? Some asshole MBA study-group approved deturrent systems? They've got some walls... is that it? What the fuck do they have to deal with a guy that walks in, takes some shit and walks out? I'm sure their training video from the legal dept. makes it perfectly clear not to fuck with a white guy unless the motherfucking district supervisor's supervisor approves of it. Oh, I wish they had those riding lawn mowers out front like Home Despot does, that would be sooo easy.
