yet another incident that proves eyewitness accounts are some of the most unreliable pieces of evidence
think about it, you don't remember someone like an exact photograph, there are so many other factors that come into play, human memory is in no way exact, especially when it comes to this
its not the girls fault, she told what she thought was true
its the damn jury's fault, although they should not have to pay, we as a public should have to pay and will pay when he seeks damages from the county/state
jurys too often make decisions based on their gut "feeling" or the defendants personality - which should only hold weight when it works to the defendants innocence. More emphasis MUST be placed on the benefit of the doubt, and only physical evidence should take away from that doubt.
how many wrongful convictions do you think occur at the misdemeanor level? speed trials consisting of an officers word (based on eyewitness accounts) against a defendant's word is all that is needed to convict.
our justice system is fubar

shit like this makes me hate our legal system, esp before there was so much science involved. the cops could have easily convinced the girl that this was the right guy. she's 12 and manipulatable (sp?) seriously the dude should have taken the guilty plea and probation but the fact that they offered him such a stupid sentence for rape (3 months probation?!?) only further proves they knew they had no case..and got lucky as shit. it blows my mind that our cops/prosecutors consider themselves to have done a better job if someone does more time, whether it's fair or not 8/30/2007 11:09:23 AM |

If anything I believe that the mother of his son should be suing the state just like I believe Dail should be able to do (for more money than he is already receiving). The state robbed the mother of her life as well but not on nearly the same level as they did with Dail himself.

Quite the opposite, which is why the reporter commented on it.
Think about it. Somebody locks you up when you're 18. They tell you when to sleep, when to eat, when to exercise, when to work, when to shower, etc... You have to ask permission to use the fucking restroom! They search your "room" randomly to make sure you're not being naughty...
So how could that environment be ideal for fostering growth and maturity? Of course, if by growth, you mean learning how to prosper in the prison economy and not get your ass beat...10/24/2007 10:31:21 PM |
