From my reading of it, they were promised immunity from prosecution for statements (probably connected to an investigation of Blackwater, and not their particular incident). And when whatever investigation their statements were given for didn't go anywhere, they were charged based on the statements they gave. Sounds like the judge felt that was more or less compelling them to testify against themselves.

I feel the same way about this case that I do about most that get off on technicalities and the like. Glad that our system doesn't allow people to be rail roaded but unhappy that essentially the truth of a crime (or lack thereof) was essentially tossed out because of mishandling on the part of a prosecutor or defense.

Also, why were they charged and prosecuted here in the US? They committed a crime in Iraq. Iraq has a functioning, legitimate government. Why weren't they prosecuted there?

The SOF agreement between Iraq and the US prevents contractors and military personnel from being tried for crimes by the government of Iraq.

This was changed (for contractors at least) after the incident being discussed in this thread. If the same incident occurred today, Blackwater could be tried by the Iraqi government.

^ They weren't acquitted. The charges were dropped, so their guilt or innocence hasn't been legally determined.

Dropped charges =/= innocent (and, of course, an indictment =/= guilty).

Yes I know about that stupid/sad turn of events, but for all practical purposes, and especially for the victims and their families, the message the US sent is that they are not guilty.

Reminds me of a Boston Legal episode in which a Senegalese immigrant's college-going son was shot in the face by a robber in a park, but since evidence was obtained using illegal search warrants, all charges were dropped and a cold-blooded murderer was let go free.

I don't know of stupider and more unjust legal bullshit.
