How is this an ACCIDENT?
The guy was driving drunk. It should be EXPECTED that you're going to get in some sort of wreck or hit something if you drive drunk. It would be an ACCIDENT if you DIDN'T hit something.

a few things:
When you're 21, i don't care how much of a partier you are- you are not an experienced drinker. Shit, I'm 25 and still have to have friends hide my keys- and I've been in this game for years. I wonder if he passed out after his big binge drinking night and woke up the next morning assuming he had sobered up. I mean, that's the beauty about being drunk- you feel just fine! Did he think he was just hungover?
I'd be so bold to say that the only way you know you're drunk WHEN you're drunk is because you can calculate how many beers you've had and compare that with your tolerance. Once you fall asleep, don't you just assume you'll be sober when you wake up the next morning? Sure, looking back when you're sober you're like "yeah, duh, i was drunk." But when I'm trying to figure out whether or not I can drive is when I can actually trust the math: More than one beer/hour average for me means I can't drive. Rather than saying, "How do you feel about driving right now?" because, of course, i'm going to say "I'm just fine to drive!"
Let me draw it out for the visual learners: ---------------- Wasted/puking/health issues - you've convinced some others to take shots of whiskey, bought a hot chick something fruity (Jokes on you, she wasn't even hot), and you're polishing off your 8th or 9th beer, in fact, it's laying beside you when you pass out. You'll find it in the morning and swear you'll never touch the shit again. (you think the front yard looks like a good spot for a nap) ------------- Hammered 5-7 beers and you've probably taken a shot or two of jager - wobbling, obviously different in mannerisms (you think people are talking funny- so you yell) ------- Drunk- 4-6 beers- behavior is slightly modified and delayed (you think dumb shit is funny) ----- Buzzed- 2-3 beers - Still able to conduct yourself, first signs of inebriation (you feel like you're hanging out with some friends, some really fun friends) -- Sober - until 1 beer - (you feel like you're at work/in school) - Drunk/Hungover continuum - Sluggish and tired -- Tired, lethargic, slight headache ----- Food is undesirable -------- Thinking about food makes you want to puke- but you don't puke ------------ You feel so sick you throw up over 4 hours since your last drink
If you ask me if I'm drunk WHEN I'm drunk- I'll say no. What'd he blow? A .12? That's quite a bit of alcohol in your system. I know .12 is an empirical and objective measurement- but is a .12 bac after you've had alcohol in your system for 12+ hours any different than a .12 bac in your system for less than 3 hours? There must be! He must have been blitzed last night. But some people assume just because they passed out, the alcohol is out of their system.
Okay, did the guy ever pass out? Could he have just woken up and mistaken STILL being drunk with that horrible hungover feeling ?

I mean, my mom rides her bike daily. She's damn near 60, also. If this dude killed my mom I'd be devastated. I'd probably kill myself if this were my mom. However, in a court of law, the kid is still entitled to a fair trial. I'm just playing the devil's advocate and putting everything into context. Dude was not a heartless killer. He is just a fucking kid!!!! I saw footage of him on the news tonight- he's obviously scared as shit. He'll never be the same person ever again. Kids like him who have been given a second chance are the same kids that become leaders in the community. Learning from mistakes and their consequences is more empowering than using tax money to sit in a cell for the rest of your life, and a hell of a lot more empowering than being put to death before you're 25 years old.
I think these two posts were spawned by the dipshit who thoughtlessly said "fry the bastard" earlier in this thread. How can you say such a hateful statement? That statement is more hateful than the "murder" he committed. I think we should "fry" people based on how hateful their crime was.

Reid, 21, of 310 S. Sixty Court in Graham, registered a 0.12 in an alcohol breath test, police said.
He was charged with one count each of driving while impaired, felony assault by motor vehicle and failure to reduce speed.
Leidy was riding on the right-hand side of the road and was wearing a helmet when she was hit, police said.
She was transported to WakeMed in Raleigh with a ruptured aorta. Leidy died at 7:45 p.m., a WakeMed spokesperson said.
"There's no way I can forgive him for doing that because he hurt my friend," Foote said.
Reid, a junior engineering major at NCSU, was released on a $10,000 secured bond Wednesday evening. Reid could face additional charges in connection with Leidy's death.
"I think it's unfortunate. The kid was 21 and celebrating. I hope to God he doesn't ever drink again,โ Foote said.
Reid has hired lawyer Rusty DeMint. His first court appearance is scheduled for Thursday.
WRAL reached DeMint Wednesday night, but he would not discuss the case." |

I think it still takes three prior DWIs to bump you to a felony on your fourth offense.
But they could charge him with felony or misdemeanor death by vehicle
