I imagine this would be ruled on a case by case basis...

I'll admit that I have never come across a case similar to the following hypothetical, but I imagine from other rulings that this would be self defense:

I spring-gun my bed-cover at night before i go to sleep. An intruder enters, pulls back my sheets, and is shot and killed. I am willing to bet that this situation would constitute self defense.

Now if I did that and was not at home, it would fail as a defense. Similarly, if the person happen to be my wife, I would at minimum be guilty of manslaughter and subject to all sorts of torts claims.

thats what your parents tell you when you get a new BB gun. and its legally the safest thing to do and is practiced by the police. but shooting to wound is not a new thing

I can't research this right now. But does anyone remember the outcome of the trial for that texas man that shot and killed burglars he saw breaking into his neighbor's home?

fairly recent case I think

Grand jury didn't even indict him...

but that's texas law and they are certainly in a minority on a number of issues.

what if the dude who allegedly boobytrapped his house (i say allegedly because they say the house has been abandoned for years, maybe some other hoodlums set the traps) put up some signs that said "DANGER: TRESPASSERS WILL BE SHOT"...is it still illegal then?

yes because you cannot simply avoid most laws by making disclaimers.

It's like those bullshit signs on dump trucks that claim they are not responsible for debris falling from the vehicle. They have a duty to secure their payload, plain and simple.

i understand that, but they're also operating on public roads

anyone has the right to use public roads

anyone does NOT have the right to break into your house

its not like the booby trap was out on the sidewalk

^I think what Nerdchick MEANT was you should never point a gun at someone unless you're WILLING to kill someone...

it's legal. in texas, you can shoot anyone that is on your property/stealing said property (even a neighbor's) without permission.

yo party people you are generally liable for spring guns or other set traps on your property. it isn't self defense. and it isn't defense of property. it isn't really anything at all except you getting fucked (and killing someone so i guess they get fucked too).

OK, so update on story. Owner interviewed, didnt do it. Son pending, possibly did it. Police think place was a drug house at one point without owners permission/knowledge.

That said, I withdraw my objections on this being a 2nd amendment defense. Nail the bastard to the wall.

I was basing my assumptions on the owner did it, and nothing else illegal.

look at it this way: mr. volunteer firefighter is probably gonna assume that your windows aren't booby trapped, and if your house is on fire and he's crawling through the window to save your ass, he isn't gonna appreciate a shotgun blast to the chest.

How do you know he was in there to steal? Maybe he was just being a curious, dumb kid. Where I grew up in NJ, there were a couple of abandoned houses in the woods near our place. My sister and I used to break into them just out of curiosity more than anything. You can see some cool shit in old abandoned houses.

Well when you're 10 and a place is in the middle of nowhere empty for as long as you've been alive, you're not really thinking that someone will be in there, or booby traps for that matter. We did sometimes find some raccoons camping out though
