probably the car accident...doesnt NC have some sort of law that says you can be held liable if you are only 1% at fault? You know, people are hurting in this economy and will sue for any reason.

I thought that law you're referring to was along the lines of if you're even 1% at fault, you can't sue the other driver, because you contributed to the accident.

Yeah I think the % at fault is determined by the insurance companies, not the police or court. Basically if it is 1% (or more) your fault you won't see a dime from the other person (or his/her insurance company).

You're right, we're one of the last states who has a Contributory Negligence law. Which basically is, if your negligence had ANY part at all in causing the accident then it bars any claim you might have had. Seat belts, speeding, etc, would all fall into this category.

The percentage at fault is determined by an "expert" not the insurance companies. But, you are right in that they aren't going to pay if you're at fault, because they know that if you did bring it to court, you can't win anything here.

... Apparently someone actually wanted to sue the previous homeowner.

I guess that's what happens when I call the Sheriff's office and have them page the officer and he calls me back from home. He thought I was the dude who was actually being sued.

Looks like I'm in the clear.

be careful, did you read about that NC guy that bought a house that apprently was used for drug dealing in the past? (crackheads would show up all hours of the night). Well, one day he saw a truck pulling up in the driveway and went out to see who it was...he got ran over and the case is cold.....
