the school is in no way responsible. her classmates would have been just as likely to tease her outside of school. her mother should have paid more attention to the needs of her daughter. plain and simple. had she done so her daughter would likely still be alive. today.

i'm not trying to be doctor phil nor am i trying to be a dick. but when placing responsibility its clear it lies with the mother far more so than with the school. an fact which i would think to be irrefutable.

if her daughter was so distraught over the nature of these photos the mother should have noticed, consoled her, found her counseling, let her switch schools, or a hundred other things. This is another clear example of people not wanting to own up to accountability and in an effort to no blame herself the mother pushes the blame on the school so she can sleep at night.

^^ i tend to agree.

but did the girl report to school officials that she was being teased/harassed at school? (i didn't read the whole thread/links) if she did and the school did nothing, i would think they have some responsibility in the incident, but in the end, a parent needs to communicate with their children and know what is going on in their life to reduce the chances of things like this happening.

except that responsibility lies with the GIRL herself, and, to a lesser extent, the guy who sent around the pictures

1.) the girl probably shouldn't have been getting naked and allowing her boyfriend to take pictures, but that was 100% her choice (as far as i know)

2.) the guy was a class A douchebag in sending those around...i mean, even if they broke up because she cheated or something, it's pretty douchey (though i admit that if she cheated, i'd totally think about doing it, too, as punishment for being a whore)...but i didn't read the article, so i'm assuming that it was just your run-of-the-mill "we just aren't good together" breakup, which makes him an ass

3.) the girl was waaaaaaaay too sensitive...yeah, she made a mistake in letting him take pictures, but that's life...you live and you learn or you hang yourself because you're not capable of reconciling reality

4.) it's not the school's fault or responsibility, end of story...it didn't take place on school grounds (except, i assume, for the receiving of the pictures) and unless you want to get Willy Nilly in here all riled up about personal rights, you have to agree that the school has no business about what people receive on their phones...as for the bullying, it HAPPENS EVERY DAY and they can't babysit everyone

5.) the mother is only responsible in that she might have paid better attention to her daughter, but i didn't read the article, so i'm assuming she simply didn't think her daughter was suicidal

I mean at this point how does a mother not tell her child that they can go to another school or make some sort of arrangement so her daughter doesn't have to deal with that torment. It appears to me she was fully aware of the extent of her daughters despair, regardless of what she wants to allow herself to believe.

^2 pretty damn good. if i was in a situation like that my mother would have told me that i made my own bed, and that she would understand though if i wanted to do x y or z to try and ease the pain. she would ultimately describe it as an unfortunate circumstance but a great lesson learned.

well i think to be considered child porn she would have to be engaged in a sexual act. Her sitting naked does not constitute porn.

fwiw, this is why jj.am can operate so freely.

V to be more clear by sexual act I don't mean she the subject has to be engaged in sex or playing with a dildo. but if a girl is standing and topless it does not count as pornography. if she is standing completely naked and is not touching her genitals it also does not constitute pornography.

I don't think it matters if she was just sitting there naked. Although, if the guy was just distributing the photos out of meanness and not for the people to get sexual use out of them, I think that's when they would run into a sticky situation because was he exploiting her image for sexual purposes (like for others) or was he just being a dick and embarrassing her? Personally, I think it should count either way you look at it but if they were both over 18, nothing can really be done.. (About the child pornography, not in general)
