I think this lawsuit is legit, but the family shouldn't get a dime beyond the cost of medical bills.

people should be able to reasonably assume there isn't a hole in the sidewalk they're walking down. texting while driving is an entirely different thing.

This I can agree with. Maybe I'm wrong to assume they are going after free money just because they said they are filing a lawsuit. Doubt it though.

I think people frown on not watching where you're going. Texting has implications beyond simply being a teen craze that bother me, but that is beside the point.

Truth is, both groups fucked up. A settlement agreeing to cover medical costs would be fair. As far as pain and suffering, consider it a cheap lesson on WATCHING WHERE THE FUCK YOU'RE GOING!! I didn't clearly define a point to my original post. It's the fact that there are so many people that are aimlessly wandering around these days. There are many ways to preoccupy yourself while walking around the neighborhood, but awareness is important. Even if they didn't sue the company about this, there would be some heavy penalties assessed by OSHA. Although they probably wouldn't fire the workers who were in error, they will certainly be reacquainted with safety rules in a meeting and perhaps will receive re-training.

Perhaps if they're awarded millions instead of a contract to fully compensate for current and future related medical expenses the girl would only associate large open holes with "OMG Ponies!" instead of something she might want to be mindful of. The workers will learn a lesson regardless of the outcome of a civil suit.

Should've been one of those up there with a chain "blocking off" the open end. Some cones aren't enough in a pedestrian area. And I'm only speaking based on what I've seen at a few construction sites I visited while working with a company that dealt with electrical/telecom/etc systems.

The sanitation concern is legitimate as well. If you would like to confirm this, just open up a manhole for any sewer system and get your head near the opening and get a whiff and look down in the manhole with a flashlight. Given that her cut doesn't look infected in the picture, however, I'm pretty sure she's fairly lucky and just needs to pay some goddamn attention to where she's going, and the workers need to go through a training program (either with or without pay depending on how big a dick the other party wants to be).

BUT, i can see grounds for a law suit. Maybe this chick's dumbass shouldnt be the one to specifically have grounds for a suit, given that she was texting, but it could have been anyone that may have happened to eb distracted. A biker that was perhaps ready to cross the road and looking to see if any cars were coming OR individual that was walking and was just looking around. Perhaps a little kid could have gotten curious and leaned over into the well

the real issue is that the manhole should be either covered or taped off until it could be covered.

I have walked into a pole before, heck probably half a dozen in my lifetime... the poles could of just as easily been open manhole covers I guess

yeah i understand that, but no serious harm really came to her other than a few bumps and bruises. this really sounds like they want to sue because she was embarrassed.

i'm not saying its 100% her fault at all, but i really don't think it's cool to sue someone because your daughter is clumsy. it's like george of the jungle suing whoever put that tree in his way if no one yelled "look out for that tree!"
