When I was a sophomore or junior I drove an of age person to get alcohol and there was an underage person with me and some of the beer was for him. The ALE agent followed us from Food Lion (Avent Ferry) and pulled us on Lineberry. He grilled me for about ten minutes and then everyone else in the car too. They both got tickets, but I didn't get anything.

I honestly don't remember anything about it except that the guy kept asking me who the alcohol was for and I said I had no idea, but it wasn't for me (and it wasn't for me, but I knew it was for the underage person).

This all demonstrates that the only reason we have such strict prohibition is to give agents more excuses to harass people who really aren't harming anyone.

Probably has more to do with religion in this state... it's seriously the dumbest thing I've ever seen that I can't buy alcohol before 12pm on a Sunday. Get out of here with that stupid shit. They should recognize that NFL games start at 1pm and you might need time to prepare. Fuck planning ahead.

not sure how it works if you're family, i don't think the law applies because back when i was 19 i was with my brother when he bought beer, and they stopped us in the parking lot and asked for ID'S, i was under 21, but i was his brother. he let us go without saying anything

granted, we also had groceries too, so maybe he just figured we were shopping and it really wasn't for me, but either way, this law is stupid as hell

So is there an actual law where you can get a ticket for having an underage person in the car?

Doesn't matter. If you get the ticket you still have to waste time and money to fight it.

Time, yes.

Money...if you've gotten a ticket for something illegal, how do you figure?

Because some people prefer to spend a few hundred bucks on a lawyer who does this every day than to go into court, having never stepped foot in a courtroom before, and plea their case themselves.

That's a choice; smc is talking about not having a choice about spending money fighting it.

You don't have a choice.

Even if you don't have a lawyer, you still have to attend court--which means you can't be doing something else, like working or studying or attending class or drinking more beer.

There was a time when I was a freshman and I was walking from Sullivan to Carroll with a backpack full of whiskey and some disgusting scotch(I thought $15 bought quality back then) and I saw a dude from the ALE with one of the campus police searching some poor schmucks bag. All I could do was act studious like I was going to the library at 2am. He had like a 6 pack or something. It was funny after the fact.

As a general rule, never tell the cops anything. you will not talk yourself out of a situation. if you must have a made up story have one simple and very general story and have no one breaks.

following this simple philosophy has gotten me far in life and kept me both out of jail and in college.

never break.

"Yes, you are reading this correctly. If you ride in the car with a 21 year old while he/she buys alcohol the police may end up ticketing that person and making them fight it in court. It's ridiculous and it shouldn't be this way, but accept that it is what it is and just stay at the house while people make their runs.
"

This happened to my old roommate. His brother, brother's girlfriend, and brother's buddy stopped at the store on the way back from a hurricanes game.
My roommate who was having a few friends (all 21+, graduate college, working folks) went ahead and bought a case of beer so that he would
not have to make the trip tomorrow. The girlfriend and buddy sat in the car since this was going to be a short trip and they did not
need anything from Food Lion. This though was probably cause to an undercover A.L.E officer who preceded to pull them over leaving the food lion
parking lot. The cop gave the three under aged people possession tickets and my roommate a providing for a minor.

As stated on the ticket and the cops rationale was that a case (24 beers) is a lot. Since there were 4 people in the car it is obvious
that 24/4 is 6 beers a piece!

A 2nd rediculous story happened when i moved to Wilmington last August.
Apperently there is an unwritten law that one can not be with X feet radius of an alcoholic beverage if underage. My new roommate
and his girlfriend were at the beach. Luke brought along one of his 21+ friends and Alex brought along her underage friends. Since luke
and his friend were of age they were drinking while the girls were not in fear of getting caught. This did not stop officer hardass from giving
the girls tickets when he stumbled upon the scene while luke and his friend were in the ocean. Eventhough their were 4 towels down; with the
beer next to the empty towels, the pig gave the girls tickets for possession eventhough they were not drinking.

Stopping trouble makers, out of control parties, high school kids, and people acting stupid is one thing. Mind blowing is the money we spend
though to catch a 19 yr old college kid though just trying to catch a buzz on a friday night. ZOMG college kids having fun CALL FOR BACKUP
Just b.c something is "against the law" does not mean it is right or that we have to resort to Gestapo tactics to prevent said activity.

I was tailgating about 2 weeks after I got my first drinking ticket. I saw ALE in their hawiian shirts ckecking a kid near us so I quit drinking for a while. They ended up approaching us and checking everyone's ID's. Two girls in our group were underage and had gone to Bojangles to get tailgate food. They were drnking sweet tea in Bojangles cups. The ALE cops made them pour out their drinks b/c they said they smelled alcohol in it. Turns out there was no alcohol in it and they had to waste their drinks. They were pissed and tried to get the cops to pay them for their drinks. They just said they were doing their job and had a right to search people. I seriously have never been so tempted to hit a cop, but you really can't do shit in a situation like that.

I got pulled over my freshmen year while making a beer run. I was 18 and the driver, and the 21 year old friend went in to Food Lion and came out with about 12 cases of beer. When ALE pulled us over, I explained that the passenger was buying up for his party and that I was the only person he knew in town with a car. This resulted in a lecture about how they could have ticketed us for corrupting a minor or something like that, but that they had watched us in the parking lot and knew that we hadn't exchanged money or talked about anything we had. I think the only reason we got pulled was because of how full the shopping cart was when he came out of the grocery store.

FYI, they were driving a piece of shit Geo Metro, so don't think the coast is clear because you don't see anything suspicious in the parking lot. Also, getting pulled over by two dudes crammed into a Geo Metro is more depressing than getting a ticket would be. I'm surprised they were able to catch me in that car doing the speed limit while going uphill on Avent Ferry.

i was at some horrible bar in concord when I was 21 and the ALE guy came up and asked us for our IDs.

he had the crew cut and tucked in polo thang going on and it was mildly amusing. I looked about 18 when I was 21 and he looked pretty pissed he came out with nothing.

I have had my run in or 3 with ALE before, always pisses them off when i refuse to speak, just show legal id and keep going. They can arrest me, they have no right to detain me if I have legal id and have broken no laws. I also tend to open carry, as well as often CC, so far I have been lucky, and so have others, in that ever LEO encounter has been a cordial one when I am carrying, and my encounters with non uniformed officers who are on the clock have all been ones that started with them identifying themselves as they approached, and showing id.

God help any poor soul who decides to grab me without speaking first or tries to detain me without showing ID.

i sure don't go around looking to pick fights with cops like i used to, but i'd like to talk about this after what i read here!

i cant believe how many people get busted by ALE with those illegal tactics.

when they ask if you can look in your bag, just pretend like its a bum that just asked you for a $5. say hell no and keep walking.

as for people saying the cops will "make" you anyways, and use a dog etc etc, that's all a last resort to scare dumb college kids because the ONLY legal evidence he can collect would be from you voluntarily. you gotta remember that if he had probable cause to look in that bag, he could just take it from you.

say no, walk away, if he keeps bothering you, call your attorney. relay the message to the officer that that unless you are under arrest, you're leaving. and, no, you won't get in trouble for saying that.

and it doesnt matter what i have on me, or whether or not i'm doing something wrong. its about being able to live your life freely and to go shopping without a cop rushing you in the dark to annoy you

that's all well and good, but for all of your internet bravado don't fool yourself into thinking that someone who shoots a cop won't get thrown under the jail, regardless of your fucking concealed carry license.

This happened to my buddy in Greenvile. After walking out of the store, having purchased beer underage, some guy grabbed his arm.
My friend has a suspicion it was ALE but as sketch as greenvile is and having not identified himself he straight up leveled the cop
with a punch to the face. After knocking the cop down and running; he eventually got caught by another officer.

The whole thing, including the purchasing alcohol underage, ended up getting dropped in court since the cop did not announce his presence
or show his badge before grabbing my buddy.

They should teach this in Orientation.

I wonder if ALE cops seriously go home every night with a feel gooder attitude like they are actually making a contribution to the betterment of our society.

There is a special place in hell reserved for ALE cops right next to parking Nazi's, tow truck drivers, and NARCs.

They shouldn't give out a ticket no matter where the alcohol is as long as it is unopened.
