Yeah it sucks how if you refer to a group of minorities who descended from enslaved tribalistic people in Africa and are often disparagingly referred to as "savages," you are assumed to be racist, doesn't it?
I mean, you weren't trying to be racist by calling them "savages," right? You were just trying to be negative!6/16/2010 6:30:38 PM |

Why did the cop only throw one punch? He sure was niggardly with his pugilism. 6/16/2010 6:33:11 PM |

Writing tickets for Jaywalking just creates more tension between law enforcement and civilians. While I think the officer was on a power trip trying to cite someone for jaywalking, a simple Warning or request to "cross at the side walk for your own protection" lecture would have sufficed. I do 100% agree with Restricted, once the woman put her arm on the cop all bets are off. The cop had a complete right if not duty to defend himself by use of force. Who knows what that woman was about to do, attempt to grab his gun or attack him. This chick deserves what she got.
The only reason this story has any air time is because the media is trying to play on the "ZOMG DISCRIMINATION, COP HITS POOR INNOCENT BLACK WOMAN". Give me a break this is not the 60's. I'm sure the cop would have responded the same if it were a white/asian/arab/vulcan/jawa woman

The article doesn't say he wrote them a ticket, just that he had called them over to his car, and then the situation escalated.
He might have just been planning on giving them a warning before everything went south.6/17/2010 9:23:30 AM |

The only thing he did wrong was using a closed fist instead of a backhand.

This is all well and good in Cary or in Chapel Hill but jaywalking can cause SERIOUS bottlenecks in major cities and temporarily fuck up the entire infrastructure.6/17/2010 11:17:23 AM |

you are a fucking retard, stop trying to be a lawyer. A person travelling at 150 mph is probably going to be held as reckless, which would make that person liable. contributory negligence is limited to negligence cases, and somewhat limited even in that spectrum6/17/2010 11:31:27 AM |

This thread really shouldn't have anything to do with jaywalking. the cop was doing what was asked of him. we don't see anything that happened before things got heated (thanks to a guy that obviously has nothing better to do than go around looking to film videos that he can put on youtube). 6/17/2010 2:36:50 PM |

looks like the woman deserved it. the first woman was resisting arrest, and when the second woman physically attacked the officer, then it became a felony, and the officer had to protect himself against an angry mob. 6/17/2010 10:53:06 PM |

Uh oh, some douche maybe just finished his first year of law school. I'll give you an exaggerated case of 150mph vs pedestrian, but 50mph in a 35 would be different. What about a drunk driver who hits someone who's changing a tire over the white line?6/18/2010 12:11:50 AM |

Quote : | "In NC, if someone is hurt by someone else's negligence, they can't recover any damages." |
I think what you meant to say is if you are hurt by someone else's negligence, but your negligence contributed to the negligent breach, then you can't recover damages in NC. Washington, DC is the same way, but other than DC, MD, VA, NC and ALABAMA, no states work that way. So Washington state, no.
Quote : | " Say for instance a driver who is speeding hits a pedestrian who is jaywalking. Because that person was jaywalking, they can't recover damages from the driver or his insurance, even if he was doing 150mph.
NC is one of few states that have this legal framework. However, I don't know if Washington (where this event took place) has that law.
Conversely, say I was driving down the road and I hit a pedestrian who was jay walking. There were witnesses who said I was speeding. If Washington is a comparative negligence state, and it went to trial and a jury found that the accident was 70% my fault, because the witnesses said I was speeding, the pedestrian (plantiff) could recover 70% of their damages from my insurance and assets.
Did that help?" |
